CIRCULAR
Regulations on creative activities, performances and art exhibitions in the People's Public Security
Pursuant to Decree No. 01/2018/ND-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Public Security;
Pursuant to Decree No. 103/2009/ND-CP dated November 6, 2009 of the Government promulgating the Regulations on cultural activities and public cultural service business;
Pursuant to Decree No. 79/2012/ND-CP dated October 5, 2012 of the Government regulating art performances, fashion shows; beauty and model contests; circulation and trading of audio and video recordings of music, dance and theater; Decree No. 15/2016/ND-CP dated March 15, 2016 of the Government amending and supplementing a number of articles of Decree No. 79/2012/ND-CP dated October 5, 2012 of the Government;
Pursuant to Decree No. 113/2013/ND-CP dated October 2, 2013 of the Government on fine arts activities;
Pursuant to Decree No. 72/2016/ND-CP dated July 1, 2016 of the Government on photography activities;
At the request of the Director of the Department of Party and Political Work,
The Minister of Public Security issued a Circular regulating the activities of art composition, performance and exhibition in the People's Public Security.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation
This Circular regulates the activities of art composition, performance and exhibition in the People's Public Security.
Article 2. Interpretation of terms
In this Circular, the following terms are construed as follows:
1. Artistic creation activities in the People's Public Security are activities organized in the form of competitions, campaigns, creative camps, commissioned creations or individuals self-creating works of song, dance, music, stage scripts, literature, fine arts, and photography.
2. Performing arts activities in the People's Public Security are activities of presenting programs, performances, and plays to officers and soldiers, including: performances by professional art troupes; performances, competitions, and mass art festivals; cultural exchanges and performance activities serving political tasks.
3. Mass performing arts activities are activities that bring programs, performances, and plays to the public through performances by non-professional artists;
4. Professional performing arts activities are activities that bring programs, performances, and plays to the public through the performances of professional actors and professional performing arts units.
5. Art exhibition activities in the People's Public Security are to organize the announcement, display, propaganda, and introduction of works of song, dance, music, stage scripts, literature, fine arts, and photography to the public.
6. The People's Public Security's mass art groups, teams, and clubs are non-professional art organizations established, managed, and directed by competent authorities.
Article 3. Responsibility for managing artistic creation, performance and exhibition activities in the People's Public Security
1. The Minister of Public Security unifies the management of artistic creation, performance, and exhibition activities in the People's Public Security.
2. The Department of Party and Political Affairs is responsible for assisting the Minister of Public Security in managing artistic creation, performance, and exhibition activities in the People's Public Security.
3. The head of the unit or local police, within the scope and authority of his/her authority, shall manage the activities of artistic creation, performance, and exhibition at the unit or locality. The unit shall provide political advice to assist the head of the unit or local police in managing the activities of artistic creation, performance, and exhibition at the unit or locality.
Article 4. Funding for organizing artistic activities in the People's Public Security

1. Funding for organizing creative activities, performances, and art exhibitions in the People's Public Security is allocated in the annual security budget estimate assigned by the Ministry to the Public Security units and localities; from local budget sources; from mobilization, sponsorship, socialization, and other legal funding sources according to the provisions of law.
2. The preparation of estimates, management, use and settlement of funds for organizing creative activities, performances and art exhibitions in the People's Public Security shall be carried out in accordance with the provisions of the State Budget Law and documents detailing the implementation of the Law.
3. Funding for training and professional development in cultural and artistic work shall comply with regulations of the Ministry of Public Security on management and use of training and development funds in the People's Public Security.
Chapter II
CREATIVE ACTIVITIES
Article 5. Requirements for work content
1. Ensure compliance with the Party's guidelines and policies, the State's policies and laws on building and developing Vietnamese culture and people to meet the requirements of sustainable national development and international integration; the orientation of the Central Public Security Party Committee and the Ministry of Public Security on cultural and artistic work in the People's Public Security.
2. Propagating and educating the traditions of the Party, the nation and the People's Public Security; educating ethics, cultural lifestyle, and the values of "truth, goodness, and beauty"; meeting the needs of enjoying spiritual culture of the People's Public Security officers and soldiers.
3. Reflect the thoughts, aspirations, feelings and responsibilities of People's Public Security officers and soldiers; praise and commend good people, good deeds; kind deeds; advanced models and beautiful images of People's Public Security officers and soldiers.
4. Fight against and criticize negative and deviant manifestations of political ideology, moral qualities, lifestyle, posture, etiquette, manners, communication culture and violations of People's Public Security officers and soldiers.
5. Not contrary to social ethical values, standards, customs and culture of the nation; not defaming or tarnishing the image, honor, reputation and traditions of the People's Public Security.
Article 6. Management of creative activities
1. Department of Party and Political Affairs assists the Minister of Public Security
a) Manage and orient creative activities in the People's Public Security; inspect and evaluate artistic creative activities of the Public Security units and localities;
b) Manage and orient the activities of units and professional associations with the function of professional artistic activities in the People's Public Security;
c) Manage and orient creative activities on the topic of the People's Public Security of units and individuals outside the People's Public Security in coordination with units within the People's Public Security.
2. The head of the unit or local police manages the creative activities of the unit, locality and its officers and soldiers.
Article 7. Organization of creative activities
1. The Department of Party and Political Affairs organizes or guides the organization of creative activities on the topic of the People's Public Security to celebrate the anniversary of the People's Public Security tradition day and the "All people protect national security" festival every 5 years; or when required to serve political tasks.
2. Heads of Public Security units and localities organize or coordinate the organization of creative activities on the topic of People's Public Security at their Public Security units and localities; organize for Public Security officers and soldiers to participate in creative activities organized by the Ministry of Public Security, departments, ministries, branches, and professional associations at the central or local level.
3. Order of organizing creative activities
When organizing creative activities, the unit and local police must comply with the provisions of Article 11 of Decree No. 113/2013/ND-CP, Article 9 of Decree No. 72/2016/ND-CP and the following provisions:
a) Before organizing creative activities, the unit and local police must develop a plan and send a report to the Ministry of Public Security (through the Department of Party and Political Work), in which the plan must clearly state the scale; form of organization, genre, theme; time, location of organization and participants;
b) Upon completion of the composition activity, within 15 working days, the unit or local police shall report the composition results to the Ministry of Public Security (through the Department of Party and Political Affairs);
c) People's Public Security officers and soldiers are free to create works according to the provisions of law. For works on the subject of People's Public Security, they must ensure the content requirements as prescribed in Article 5 of this Circular and report the results of the creation to the head of the unit.
Chapter III
PERFORMANCE ACTIVITIES
Article 8. Program requirements and performance content
1. Not violating the provisions in Article 3 of the Regulations on cultural activities and public cultural service business issued together with Decree No. 103/2009/ND-CP; Clause 2, Article 6 of Decree No. 79/2012/ND-CP.
2. Correctly implement the authority and procedures for granting performance licenses as prescribed in Articles 9 and 13 of Decree No. 79/2012/ND-CP and Clause 5, Article 1 of Decree No. 15/2016/ND-CP.
3. The form and content of the program and performance must not be contrary to the values, ethical standards, fine customs, Vietnamese cultural traditions and the traditions of the People's Public Security; must not defame or tarnish the image, honor and reputation of the People's Public Security.
4. The use of People's Public Security uniforms in performing arts activities must comply with the provisions of the People's Public Security Ordinance, except for performances requiring technical elements or artistic requirements.
Article 9. Management of performance activities
1. Department of Party and Political Affairs assists the Minister of Public Security
a) Manage performance activities on a force-wide scale; foreign performance activities; performance activities coordinated between the Ministry of Public Security and central ministries and branches; competitions, performances, and art festivals in the People's Public Security;
b) Manage activities; approve content and art programs of professional art troupes of the People's Public Security;
c) Approve the content and art programs of units and individuals representing the Ministry of Public Security performing abroad;
d) Conducting performances of art programs and contents of units and individuals outside the People's Public Security to serve officers and soldiers organized or jointly organized by the Ministry of Public Security.
2. The head of the police unit and locality is responsible for:
a) Manage performance activities of the unit and locality; performance activities are coordinated with local departments, branches and sectors;
b) Manage and guide the activities of mass art groups, teams, clubs and professional art groups under the local and unit police (if any);
c) Review the content and art programs of affiliated units and individuals before performing; review the content and art programs of units and individuals outside the People's Public Security before performing for officers and soldiers at their units and localities.
Article 10. Organization of mass art performances
1. Department of Party and Political Affairs assists the Minister of Public Security
a) Organize art performances, competitions, and festivals (hereinafter referred to as performances) for the entire force to celebrate the anniversary of the People's Public Security tradition day and the "All people protect national security" festival every 5 years;
b) Organize, coordinate the organization or participate in mass art activities organized by central ministries, branches or performing activities serving other political requirements.
2. The head of the police unit and locality is responsible for:
a) Organize mass art performances to celebrate the anniversary of the People's Public Security tradition day and the "All people protect national security" festival every 5 years;
b) Organize, coordinate the organization or participate in mass art activities organized by local departments, branches and sectors or performance activities serving other local political requirements.
3. When organizing mass art performances, the unit and local police must comply with the provisions of Article 15 of Decree No. 79/2012/ND-CP; Clause 9, Article 1 of Decree No. 15/2016/ND-CP; Circular No. 09/2016/TT-BVHTTDL dated October 14, 2016 of the Minister of Culture, Sports and Tourism regulating the organization of mass art competitions and festivals and the following provisions:
a) Before organizing the festival, a plan must be developed and reported to the Ministry of Public Security (through the Department of Party and Political Affairs), in which the plan must clearly state the purpose, scope, theme, content, program, time, venue and participants;
b) Within 15 working days after the festival ends, the results of the festival organization must be reported to the Ministry of Public Security (through the Department of Party and Political Affairs).
4. The unit and local police establish groups, teams, and mass art clubs to perform to serve political tasks and meet the cultural and spiritual needs of the People's Public Security officers and soldiers.
The composition, number of members, living and training regime of the mass art troupe, team, and club are decided by the head of the unit or local police.
Article 11. Organizing professional performing arts activities
1. Professional art units in the People's Public Security organize performance activities according to the provisions of Decree No. 79/2012/ND-CP; Decree No. 15/2016/ND-CP; Circular No. 01/2016/TT-BVHTTDL dated March 24, 2016 of the Minister of Culture, Sports and Tourism detailing a number of articles of Decree No. 79/2012/ND-CP; Circular No. 10/2016/TT-BVHTTDL dated October 19, 2016 of the Minister of Culture, Sports and Tourism amending and supplementing a number of articles of Circular No. 01/2016/TT-BVHTTDL and the following provisions:
a) The establishment of the Art Council of professional art units of the People's Public Security shall be implemented in accordance with the provisions of Circular No. 15/2013/TT-BVHTTDL dated December 24, 2013 of the Minister of Culture, Sports and Tourism on promulgating the Regulations on organization and operation of the Art Council in the field of performing arts;
b) Report to the Department of Party and Political Affairs to approve the content and program of the troupe's performing arts activities according to the provisions of Clause 1, Article 9 of this Circular.
2. Artistic units outside the People's Public Security performing for People's Public Security officers and soldiers must have the consent of the unit head according to the management authority prescribed in Clause 2, Article 9 of this Circular.
The political staff unit advises the head of the unit and local police to assess the content, program, participants and performance organization procedures of art units to ensure compliance with the provisions of Decree No. 79/2012/ND-CP, Decree No. 15/2016/ND-CP and regulations of the Minister of Public Security.
Chapter IV
EXHIBITION ACTIVITIES
Article 12. Requirements for exhibition activities
1. Do not violate the provisions of Article 8 of Decree No. 113/2013/ND-CP, Article 5 of Decree No. 72/2016/ND-CP.
2. Correctly implement the authority and procedures for granting exhibition licenses as prescribed in Articles 14 and 15 of Decree No. 113/2013/ND-CP, Articles 11 and 12 of Decree No. 72/2016/ND-CP.
3. The form and content of the exhibition must not be contrary to the values, ethical standards, fine customs, Vietnamese cultural traditions and the traditions of the People's Public Security; must not defame or tarnish the image, honor and reputation of the People's Public Security.
Article 13. Exhibition management
1. Department of Party and Political Affairs assists the Minister of Public Security
a) Manage art exhibition activities on the People's Public Security theme throughout the force; art exhibitions on the People's Public Security theme abroad;
b) Review the content and quality of art works on the People's Public Security theme of the unit and local Public Security and of units and individuals outside the People's Public Security coordinating the exhibition.
2. The head of the police unit or locality manages art exhibition activities at the police unit or locality.
Article 14. Organization of exhibition activities
1. Department of Party and Political Affairs assists the Minister of Public Security
a) Organize art exhibitions on the theme of the People's Public Security on a full scale to celebrate the anniversary of the People's Public Security tradition day and the "All people protect national security" festival every 5 years; or when required to serve political tasks;
b) Coordinate the organization or participate in art exhibitions on the People's Public Security theme of ministries, departments and central branches.
2. The head of the police unit and locality is responsible for:
a) Organize art exhibitions on the theme of People's Public Security at your unit or locality;
b) Coordinate the organization or participate in art exhibitions organized by local departments, agencies and branches.
3. Exhibition organization sequence
a) Before organizing an art exhibition, the unit or local police must develop a plan and send a report to the Ministry of Public Security (through the Department of Party and Political Work). The plan must clearly state the theme, content, time, and location of the exhibition;
b) After the exhibition ends, within 15 working days, the unit and local police shall report the exhibition results to the Ministry of Public Security (through the Department of Party and Political Work).
