The solutions that the thesis aims to improve the law on social housing loans for low-income people at commercial banks include: general solutions and specific solutions. For general solutions, the thesis aims to build and improve mechanisms and policies to improve skills and legislative capacity for staff, staff building and implementing legal policies on social housing loans. This is considered an important and essential solution to improve the quality of social housing loans. In addition, the thesis also aims at specific solutions such as: Improving legal regulations on subjects, conditions, principles and legal procedures for social housing loans for low-income people at commercial banks.

CONCLUDE


The National Housing Development Strategy for the 2011-2020 period approved by the Government in November 2011 affirmed that housing development is the responsibility of the State and the whole society. In major cities across the country, there are currently about 300,000 households living in simple, unstable housing, including more than 1 million houses with an area of ​​less than 30m² (less than 7m²/person). The Ministry of Construction forecasts that by 2020, the housing demand for low-income people in major cities will be about 1 million units, but the current supply only meets about 10,000 units/year. Meanwhile, the latest statistics show that currently, Vietnam has 33.1% of the population, equivalent to more than 30 million people, living in urban areas. Among these, a significant number are people from rural areas to urban areas, earning a living in industrial zones and urban areas with low incomes and no stable housing. Thus, meeting the housing needs of this labor force is becoming increasingly urgent and is a major concern of the State as well as the whole society. Therefore, in order to effectively implement the policy of developing social housing for low-income people to create housing for low-income people, ensure the right to housing of citizens, ensure stability, social security, and at the same time create a driving force to promote socio-economic development, it is necessary to quickly perfect the law on lending to buy social housing for low-income people in order to create a framework and legal corridor for this credit activity at commercial banks.

With the thesis topic: "Law on lending to buy social housing for low-income people at commercial banks", the author has initially researched and clarified some theoretical and practical issues on the law on lending to buy social housing for low-income people. Below are some research results of the thesis.

Firstly, the thesis focused on analyzing and clarifying a number of theoretical issues as well as the theoretical framework on social housing, characteristics, and subjects eligible for preferential treatment in purchasing social housing; social housing for low-income people, characteristics, subjects, and subjects.

The subjects eligible to buy social housing for low-income people are those who have stable jobs and an average monthly income lower than the income subject to personal income tax according to current personal income tax laws.

Second, from the clarification of the concept, nature, lending activities and legal regulations on lending activities of commercial banks, the thesis analyzes and discloses the content of legal regulations on lending activities to buy social housing for low-income people in the following aspects: subjects, conditions, principles and procedures for lending.

Third, the thesis analyzed and evaluated the current legal status of social housing loans for low-income people at commercial banks in terms of regulations on lending subjects, lending conditions and principles; lending procedures and some other contents, thereby pointing out the difficulties, shortcomings and causes of those difficulties and shortcomings in the process of building and implementing legal policies on social housing loans for low-income people at commercial banks.

Fourthly, based on the analysis of the current legal status of social housing loans for low-income people at commercial banks and pointing out the limitations and causes of the limitations, the thesis proposes a number of solutions to contribute to improving the legal status of social housing loans for low-income people at commercial banks. In particular, it emphasizes the role of solutions to improve the capacity and legislative level of the staff advising, building and implementing legal policies for social housing loans for low-income people at commercial banks.

Fifth, the thesis makes a number of recommendations to the State and relevant state management agencies. In particular, the author boldly recommends that social housing lending activities for low-income people should be shifted from borrowing at commercial banks to borrowing at the Social Policy Bank, and at the same time recommends that the State should have mechanisms and legal policies to create capital sources for social housing policies for low-income people in the coming time.
