(1) The term of the Community Forest Management Board is: 2.5 years.
(2) Responsibilities of the Community Forest Management Board:
- Guide and direct households to implement forest protection and development management according to the approved and recognized forest allocation plan, community forest management plan and this Convention; manage and use community funds in accordance with regulations.
- Organize mediation of disputes and violations of the Convention;
(3) Powers of the Community Forest Management Board:
- Organize forest exploitation, collect money when exploiting timber and non-timber forest products.
- Authorized to establish a village fund from revenue from exploitation services, investment money of the Project, compensation for violations of the Convention, contributions from the people, bonus sources... The establishment and disbursement of the fund must be agreed by more than 50% of the representatives of households in the community, with the inspection and supervision of the Commune People's Committee.
- Organize prevention and record violations of the Convention and State laws, report and propose to competent authorities for handling.
- Authorized to approve households to exploit and use forest products.
- Require the violator to compensate by labor and damage value according to the level of damage.
- Organize regular community meetings once a month or irregularly in June and December to assess the situation of forest protection, development and use, management and use of community funds, consider rewards and review violations of the Convention; adjust and supplement the Convention.
(4) Responsibilities of households and village members:
- Protect forests and prevent outsiders from exploiting forest products, destroying forests, and farming.
- When detecting illegal logging of community forests or slash-and-burn farming, it must be reported to the community forest management board.- Participate in implementing the community forest management plan.
Part 7. Rewards and compensation
(1) Reward.
Households that effectively implement the Forest Protection and Development Convention, in addition to being recognized by the village, are also recommended for State rewards for their achievements and given priority in meeting their needs for wood and forest products.
(2) Compensation regulations.
Households and individuals who violate the provisions of the Convention will be handled by the village in the following forms, depending on the severity:
(2.1) For violations of the general provisions of the convention
- For people in the community:
+ 1st time: Review before the community
+ Continued violations will not be considered for the need to use wood and non-timber forest products for 1 to 2 years depending on the severity of the violation.
- For outsiders: Violations will result in temporary confiscation of exhibits and means, a record will be made and a request will be made to the Commune People's Committee and relevant authorities for handling; In addition, compensation must be made in cash equal to the value of forest products at market price.
(2.2) Logging exceeding the volume, at the wrong location and tree design:
- For people in the community:
+ 1st time: Check and collect excess volume
+ 2nd time: Temporarily confiscate the exhibits and means and report to the competent authority for handling; depending on the level of violation, the Forest Management Board will consider or not consider the need to exploit timber and non-timber forest products from 1 to 2 years.
- For people outside the community, follow section b, section 2.1.
(2.3) Causing forest fires, encroaching on forests, grazing livestock and destroying forests...
- 1st time: Review and compensate for damages at a value equivalent to the damage level according to the price agreed upon by the community.
- 2nd time: Compensation for damage at market price according to the level of damage and not considering the demand for wood and non-timber forest products for 1 to 2 years.
(2.4) For violations of hunting and trapping wild animals:
- For people in the community
+ 1st time: Review before the community
+ 2nd time: In addition to confiscation of money from selling animals, compensation must be paid for the value of the animals sold and the rights to timber and non-timber forest products must not be enjoyed for 1 to 2 years.
- For outsiders:
In addition to handling according to State regulations, compensation must also be paid to the community for damages of 2 times or more the value of wild animals (according to market price).
(2.5) The provisions on compensation collection are as follows:
- 20% for the discoverer;
- 30% for participants in catching and solving;
- 50% community fund.
(2.6) Households that do not participate in activities mobilized by the community (without a valid reason) will not benefit from the community fund.
4.4 Establishment of a Village Community Forest Protection and Development Fund (Village Fund):
4.4.1. Basis for establishing a village community forest protection and development fund:
4.4.1.1. Legal bases:
The village community forest protection and development fund is established to serve common forestry activities on the forest area assigned to the community. When establishing and managing the fund, the following bases are used:
- Decision No. 106/2006/QD-BNN dated November 27, 2006 of the Ministry of Agriculture and Rural Development on promulgating the Guidelines for managing village community forests.
- Official dispatch No. 123/BNN-LN dated January 15, 2008 on pilot guidance for establishment, management and use of Community Forest Protection and Development Fund.
- Village community forest management plan.
- The desire and willingness of villagers to build, manage and use the Community Forest Protection and Development Fund.
4.4.1.2. Establishment of Village Fund Management Board and Fund Control Team:
The community forest protection and development fund is established by the community itself with the main purpose of serving the community's forestry activities such as: forest protection, forest planting, forest care, forest regeneration, forest enrichment, forest product exploitation, forest management...
The village community will elect a Management Board to manage the Fund. The Community Forest Management Board can also perform the tasks of the Fund Management Board; in case the fund has a large amount of capital, a separate Fund Management Board can be established. To implement the Community Forest Management Plan, the villages need funds to ensure financial support for the implementation of the Plan. Therefore, the villages need a fund to protect and develop the village community forest.
(1) Purpose of establishing the Village Fund:
Mobilize resources from projects, social organizations, and individuals to protect and develop village community forests, contributing to the implementation of the policy of socializing forestry.
Raising awareness and responsibility of village communities towards community forests.
(2) Operating principles of the Village Fund:
Support for community forest protection and development activities is recorded in the village's community forest management plan.
Support for community development activities to improve the lives of member households and contribute to the protection and development of village forests as stated in the Village Forest Protection and Development Convention.
The revenue and expenditure plan and the revenue and expenditure items of the Village Fund are publicly posted at public places in the village (village chief's house) and announced at village meetings, and reported to the Commune People's Committee.
Village Fund management is subject to inspection and supervision by village and commune authorities, people and organizations in the village.
(3) Responsibility for managing the revenue and expenditure sources of the village fund:
- The management of village fund revenue and expenditure will be assigned to the village community forest management board.
- The village community forest management board elects a fund management team of 3 people to monitor and manage the village fund. In which: + A head of the team is responsible for general management.
+ A deputy head of department who is also an accountant is responsible for developing a fund revenue and expenditure plan and approving expenditures.
+ One person is responsible for managing the Village Fund's cash and making payments according to the team leader's orders, recording the Village Fund's cash receipts and expenditures, reporting on the Village Fund's revenue and expenditure management situation before village meetings, and the village leader reports at least once every 6 months.
(4) Control of village fund revenue and expenditure: The control team consists of 3 people;
- The control and management of village funds is assigned to the Village Control Team.
- The task of controlling the revenue and expenditure of the village fund is: checking the revenue and expenditure of the village fund; checking whether the people supported by the fund have completed their assigned tasks well; checking whether the beneficiaries such as timber exploiters have contributed to the community according to the convention; reporting the inspection status to the village leaders and before the village meeting.
(5) Sources of revenue and expenditure of the village fund:
Revenue and expenditure management to implement community forest management activities is carried out according to the following fund sources:
(a) For project support sources:
- Activities in the annual Community Development Plan follow the guidance of the District and Provincial Project Management Boards and are approved by the Central Project Management Board. Each patrol to protect forests and prevent forest fires is supported with 10,000 VND; forest maintenance is supported with 20,000 VND/work.
- Expenses for fund management activities at the village level such as village meetings and village fund management fees are paid once.
- The remuneration for members of the Community Forest Management Board, Village Fund Management Team and Village Fund Control Team is as follows: Organized into a joint management board: Forest Management Board + Management Team, Village Fund Control Team; Total number of people is 6 people. The average monthly remuneration is 30,000 VND/person. That is 6 people x 30,000 VND/person x 12 months = 2,160,000 VND.
- Meeting expenses, rewards and other expenses are taken from the contributions of households exploiting firewood and NTFPs.
(b) For funds managed by the village:
- Revenue from community forest exploitation such as compensation and contributions when exploiting forest products are directly collected and managed by the village according to the Community Forest Protection and Development Convention.
- People who are allowed to exploit forest products will pay money to the Accountant and the village treasurer according to regulations, and can pay money once or many times.
- The money of the Village Fund will be kept by the treasurer, and a book will be kept to track income and expenditure.
- Payment from the Village Fund: Based on the annual Village Fund Revenue and Expenditure Plan, the accountant drafts a Payment Request Form for the Head of the Village Fund Management Board to sign. The village accountant will then pay the person performing the activity and record it in the cash disbursement tracking book.
- Unused village fund money can be deposited in savings to preserve capital. The deposit will be decided at a village meeting.
4.4.2. Regulations on management of the Forest Protection and Development Fund and the revenue and expenditure table of Lang Cat village: (Village Fund)
4.4.2.1. Annual revenue and expenditure planning of the Cat Village Fund:
(1) Source of income:
The project: "Community forestry pilot" in Quang Tri province has supported each commune with a budget of 93,250,000 VND (equivalent to 4,000 euros) divided equally over 5 years of planning. Thus, in the 5 years of the community forest development plan, the project supported Lang Cat village with 46,625,000 VND.
Activities in the annual community forest management plan are guided by the district, provincial and central project management boards.
(2) Estimated expenditures for the Village Fund in 5 years:
In the next 5 years, the management of the Lang Cat village community fund needs to spend 79,020,000 VND for the following activities:
- Expenses for forest protection activities: 19,500,000 VND.
- Expenses for afforestation activities: 21,000,000 VND
- Expenses for forest maintenance activities: VND 27,720,000.
- Expenses for forest management board activities: 10,800,000 VND.
- Based on the workload, current status of forest resources and labor capacity of the people, the annual expenditure plan is estimated as follows:

Thus, it is expected that in 5 years of community forest management, Lang Cat village will spend 79,020,000 VND. All revenue from the support project and capital mobilization from within the community will be transferred to the village fund, which can be saved (through village meetings for agreement) for use when needed.

CONCLUSION, PROBLEMS AND RECOMMENDATIONS
5.1.1. Regarding research results:
- The topic has analyzed the advantages and disadvantages that natural and socio-economic conditions affect the research area;
- The project has evaluated the results after more than 5 years of implementing the natural forest allocation work of Quang Tri province in two districts of Huong Hoa and Dakrong, Quang Tri province has allocated 4,024.3 hectares to the village community;
+ The assigned forest areas have real owners, so forest management and protection are stricter and more effective; forest areas are not lost, limiting illegal exploitation and slash-and-burn cultivation. Timber reserves are increasing, averaging 2 - 2.5m 3 /ha / year;
+ The forest conditions that we conduct actual surveys have fewer trees distributed at diameter levels (30 - 38cm) or higher than the desired forest model. It is necessary to have measures to promote regeneration, nurture and develop the forest appropriately to bring the actual forest model commensurate with the desired forest model in the coming years;
+ Although they have not yet benefited from the forest, people's awareness of receiving forests for management, protection and benefit has had positive changes (many village communities have applied to receive natural forests for management and protection).
