Rights and Obligations of Savings Recipient Organization

2.1.8. Form of savings deposit

(1) The form of savings deposits classified by deposit term includes demand savings deposits and term savings deposits. The specific deposit term is determined by the organization receiving the savings deposits.

(2) The form of TGTK is classified according to other criteria determined by the organization receiving TGTK savings deposits.

2.1.9. Withdrawal of principal and interest from savings deposits

(1) The depositor shall carry out the following procedures:

a) Present savings card

b) Submit a withdrawal form with a signature that matches the sample signature registered at the deposit receiving organization.

c) For Vietnamese individuals, a valid identity card or passport must be presented. For foreign individuals, a valid passport with a visa must be presented; if the depositor


If the applicant is exempt from visa in accordance with the provisions of the law on entry, he/she must present a valid passport.

d) The depositor shall carry out other procedures as prescribed by the deposit receiving organization.

(2) The organization receiving the TGTK shall prescribe the TGTK payment procedures in accordance with its business characteristics and conditions, ensuring accurate and safe TGTK payment.

(3) The currency in which principal and interest are paid (Vietnamese Dong or foreign currency) is the currency in which the depositor has deposited. For foreign currency deposits, upon request of the depositor, the depository institution may pay principal and interest in Vietnamese Dong at the exchange rate stipulated by the depository institution. Payment for odd foreign currencies shall be made in accordance with the regulations of the depository institution.

(4) For term deposits, in case the payment due date falls on a day off or a holiday as prescribed by law, the payment of principal and interest on the deposit shall be made on the first following working day.

2.1.10. Withdrawal of savings deposit before maturity

(1) Depositors are allowed to withdraw their savings account before maturity if they have an agreement with the savings receiving organization when making the deposit and must notify in advance the request for early withdrawal according to the regulations of the savings receiving organization.

(2) In case the depositor needs to withdraw the deposit account before maturity and meets the provisions of Clause 1 of this Article, the depositor shall receive interest according to the regulations of the deposit receiving organization.

(3) In case the depositor wishes to withdraw the deposit account before maturity but does not meet the requirements in Clause 1, the depositor receiving the deposit account may allow the depositor to withdraw the deposit before maturity. In this case, the depositor shall receive interest according to the provisions in Clause 2; the depositor receiving the deposit account shall have the right to determine the fee for the deposit account withdrawn before maturity.

2.1.11. Withdrawal of savings deposits by inheritance

The procedure for withdrawing TGTK according to inheritance is prescribed by the organization receiving TGTK in accordance with the provisions on inheritance in the Civil Code and relevant legal documents.

2.1.12. Withdrawal of savings deposits by authorization

(1) The organization receiving the savings deposit shall prescribe the necessary elements of the authorization letter to ensure the interests of the savings deposit owner or co-owner of the savings deposit and in accordance with relevant legal documents.


(2) After checking the legality and validity of the authorization, the organization receiving the TGTK shall base on the authorization content to make the TGTK payment.

2.1.13. Extending deposit term

When the term deposit matures, if the depositor does not come to receive the deposit and has no other request, the deposit receiving organization can add interest to the principal and extend a new term according to the agreement between the deposit receiving organization and the depositor.

2.1.14. Rights and obligations of depositors

(1) Rights of depositors

a) Depositors are paid full principal and interest of the deposit account according to the agreement with the deposit receiving organization.

b) The depositor is the owner of the savings account or co-owner of the savings account and is allowed to transfer ownership of the savings card, inherit the savings account, and authorize another person to make savings account withdrawal transactions according to the provisions of law.

c) Depositors who are owners of savings accounts or co-owners of savings accounts can mortgage their savings cards to borrow capital from credit institutions if approved by such credit institutions.

d) The depositor is the guardian or legal representative who is entitled to carry out transactions related to the deposit account according to the provisions of this Regulation and the provisions of relevant legal documents.

(2) Responsibilities of the depositor

a) Comply with the provisions of this Regulation and the agreements committed to with the organization receiving the TGTK.

b) Prior notice of early withdrawal request according to regulations of the deposit receiving organization.

c) Promptly notify the savings organization of the loss of the savings card when discovering the loss of the savings card to avoid being exploited and causing property loss.

d) Be responsible for damages caused by failure to promptly report the loss of the savings card to the savings receiving organization.


2.1.15. Rights and obligations of savings receiving organizations

(1) Rights of organizations receiving savings deposits

a) The right to refuse to receive and pay TGTK if the depositor does not comply with the provisions of this Regulation and the agreements committed to with the TGTK receiving organization.

b) The right to refuse to pay TGTK for savings cards that have been exploited but not due to the fault of the TGTK receiving organization.

(2) Responsibilities of the organization receiving savings deposits

a) Based on this Regulation and relevant legal documents, the organization receiving TGTK shall issue and publicly announce regulations on TGTK in its system.

b) Receive individuals' TGTK on the dates and times of transactions.

c) Pay the principal and interest of the TGTK on time and in full.

d) Publicly announce the deposit interest rate, interest payment method, fee level for deposit withdrawals before maturity (if any) and fee level for deposit-related services at deposit receiving and payment locations.

e) Keep the deposit balance of the savings deposit owner or co-owner of the savings deposit confidential according to the provisions of law and ensure the safety of the deposit for the savings deposit owner or co-owner of the savings deposit.

f) Be responsible for damages, violations, and abuse of the TGTK due to the fault of the organization receiving the TGTK.

g) Credit institutions are responsible for reporting to the State Bank data related to the activities of receiving and paying TGTK according to current regulations on statistical reporting regime.

h) Other organizations with banking activities permitted by law to receive TGTK are responsible for reporting to the State Bank on the status of receiving and paying TGTK according to the regulations of the State Bank.
