CONCLUSION OF CHAPTER 3


Based on the research on the theoretical basis and the current status of the law on real estate brokerage services on real estate trading floors, the author has conducted research to make comments on the need to improve the law on real estate brokerage services on real estate trading floors and proposed effective solutions to improve the effectiveness of law enforcement on real estate brokerage services on real estate trading floors. Solutions to improve the effectiveness of law enforcement on brokerage on real estate trading floors must be placed in the overall process of improving the law on real estate trading services.

Firstly , develop regulations on standard floor criteria. Currently, the number of real estate exchanges in our country has increased but the quality is not guaranteed, the operations of real estate exchanges are not yet complete, each floor operates in a different way. The old regulations on opening trading floors are no longer suitable, in terms of area, human resources, working conditions... so there needs to be reasonable adjustments to the standard floor standards.

Second , perfecting regulations on training, fostering and granting certificates of practice of real estate brokerage. Real estate brokers play the role of intermediaries, connecting people with real estate needs. They need to build their own class and brand. Work efficiency and professional ethics always go hand in hand with the brokerage profession. This demonstrates the management capacity, management level, training level of vocational training institutions, training staff to supply the market; ensuring the quality of brokerage services in the market to avoid wrongdoings, fraud, and poor capacity.

Third , issue sanctions for violations by individuals and real estate brokerage organizations. In the process of developing the guiding Decree, it is necessary to specify the regular inspection and review of the activities of the trading floor.

Fourth , the experience of countries with developed real estate markets shows that if we want real estate brokerage services to develop in a professional direction, it is necessary to have regulations on the code of conduct and ethics of brokers to create an equal relationship between brokers as well as the relationship between brokers and customers, ensuring the rights and interests of the parties involved in real estate transactions. Thereby, orienting real estate brokerage services in general and brokerage on the Real Estate Trading Floor in particular to become orderly, enhancing the reputation and position of real estate brokers.

In addition to legal solutions, solutions to support brokerage services on the Real Estate Exchange are also very necessary. In particular, innovating state management of the real estate market; creating a source of goods for the real estate market; establishing state-owned Real Estate Exchanges and perfecting the criteria and operating procedures of the standard floor to suit the reality; The State needs to build a real estate information system to support information for market participants in searching for information, grasping market developments in a timely manner; developing other business activities to support real estate brokerage activities. If real estate brokerage services want to develop, other real estate service business activities must also develop accordingly.

CONCLUDE


The activities of intermediary institutions supporting the real estate market in general and real estate brokerage in particular are important factors contributing to improving the transparency of the real estate market. The emergence of this type of service business has a positive impact on the activities of real estate business entities. The LKDBĐS was established in 2006, creating a legal corridor for brokerage activities on the SGDBĐS, partly overcoming the weaknesses in brokerage activities on the SGDBĐS, orienting brokerage activities on the SGDBĐS to develop healthily. After 8 years of implementation, the LKDBĐS in 2006 has revealed many shortcomings, the 13th National Assembly has passed amendments with many new and positive points.

The law on brokerage services on the real estate market is a complex field. Within the scope of the thesis, the author has deeply studied and researched the general provisions of the law on the real estate market, trading floors and real estate brokerage as a theoretical basis; studied the provisions of the law of some countries in the world on brokerage activities on the real estate market to find similarities between countries on this issue; studied the practice of law enforcement and the practice of brokerage activities on the real estate market.

From those studies, the author boldly proposed a number of solutions to improve the law as well as enhance the effectiveness of law enforcement on real estate brokerage services on real estate trading floors in Vietnam. Among them, there are a number of views that are consistent with the views on amending and supplementing the LKDBĐS in 2014. In addition, the author continues to propose a number of solutions to improve regulations on training, fostering and granting real estate brokerage certificates; issuing sanctions for violations by individuals and organizations of real estate brokerage, regulations on the code of conduct and ethics of brokers.

In addition to legal solutions, solutions to support brokerage services on the Real Estate Trading Floor are also very necessary. These include innovating state management of the real estate market; creating a source of goods for the real estate market; establishing state-owned Real Estate Trading Floors and perfecting the criteria and operating procedures of the standard floor to suit reality...

Through the research of the topic, the author has a deeper understanding of brokerage services on the Real Estate Trading Center and proposed some solutions to contribute to the development of brokerage services on the Real Estate Trading Center in the current "frozen" real estate market period. In 2015, the real estate market has undergone many changes, the market is "warming up", transactions are developing in an increasing direction; the need for customers to transact directly with investors still exists in parallel with transactions on the Real Estate Trading Center. Accordingly, brokerage services on the Real Estate Trading Center have been, are and will always be important and useful services to promote the development of the real estate market.
