Chapter 3 Conclusion

The policies and laws on housing lease contracts are not really safe and stable to attract investors and people to participate. Therefore, perfecting the laws as well as improving the effectiveness of law enforcement on housing lease contracts is really necessary and urgent. Perfecting the legal system on housing lease contracts creates a solid and stable legal basis as a support for housing lease transactions. When the legal system on housing lease contracts under the Law on Real Estate Business is perfected, it will create conditions to control and orient the development of the real estate market in general and rental housing in particular in accordance with the Party's guidelines and policies, the State's legal policies on housing development to ensure the people's right to housing as stipulated in the 2013 Constitution.

No matter how complete and synchronous a legal system is, if it is not enforced, it is just a formal regulation. The role of law is only achieved when that legal system is applied in practice. A complete legal system on housing lease contracts, consistent with the historical trend and socio-economic conditions, will positively affect human behavior, creating a favorable environment for the formation and development of legal awareness. At that time, legal adjustment of housing lease contracts will be voluntarily complied with by the subjects, limiting disputes and ensuring the rights and legitimate interests of the parties. Therefore, improving the effectiveness of law enforcement on housing lease contracts will create a stable mentality for people, so that people have more choices suitable to their economic conditions and the process of finding jobs in line with the open trend of the labor market. At the same time, when the law on housing lease contracts is stable, creating a foundation for the rental housing market to develop into a trend, it will encourage economic sectors to participate in creating a rental housing fund, gradually meeting and improving the housing quality of the people.

CONCLUDE

The need for housing is one of the basic essential needs directly related to human existence and development. However, people cannot always own a house. With the average income of Vietnamese people and current housing prices, buying a house is impossible for most people. Faced with this situation, most people in need of housing in big cities turn to rental housing products to stabilize their living conditions. The formation of a rental housing market not only contributes to solving housing difficulties but also participates in regulating current housing prices. The stability and acceptable prices of rental housing will partly solve the housing needs of people, giving people the opportunity to live in safe houses and improve their living standards.

Developing the rental housing market first of all requires a solid foundation from the legal system. However, the current legal regime on rental housing lacks a systematic structure, is scattered in different legal documents, and has not created a safe legal corridor to ensure the parties when participating in the relationship. Assessing this issue, in recent times, the system of legal documents related to housing policy has been constantly developed to ensure the right to safe housing for people. With the determination of the Party and the State to achieve the goal of all people having the right to legal housing, it is necessary to consider this a necessary factor for comprehensive human development, and at the same time a decisive factor in developing human resources to serve the cause of national construction and development.

Housing lease contract under the Law on Real Estate Business 2014 ” is a topic that deeply analyzes the concept, legal characteristics and components of housing lease contracts under the Law on Real Estate Business 2014. In addition, it studies the system of legal regulations regulating housing lease contracts in the Civil Code, Housing Law and related legal documents to clarify


The paper presents theoretical and practical issues in applying the law in resolving disputes over housing lease contracts. Thereby, it proposes a number of recommendations and solutions to improve the provisions of the law on housing lease contracts, creating a synchronous legal corridor as a foundation for the development of the real estate market in general and ensuring stability for housing lease transactions in particular in Vietnam.

Completing the legal system on housing lease contracts will create a solid legal basis for establishing and implementing housing lease transactions, gradually changing people's awareness, creating a suitable direction in the socio-economic conditions of Vietnam in particular and the development trend in the world in general. When the rental housing solution comes into life, it will reduce financial pressure for people when they need a stable place to live, fulfilling the Constitutional goals and housing policies of the Party and State, and at the same time opening up a new business direction for the real estate market.

Due to limited research ability, the study of the law on housing lease contracts under the 2014 Real Estate Business Law still has many shortcomings. The author hopes to receive comments from teachers and readers so that the thesis can be more complete./.
