As analyzed above, implementing the Law on Economic Development is not only an effective management tool for managers and leaders at all levels, but also contributes to ensuring the rights and interests of collectives and individuals.

2.2. CONTENT AND FORMS OF IMPLEMENTATION OF THE LAW ON EMULATION AND COMMENDATION

2.2.1. Contents of implementing the law on emulation and rewards

The Law on Competition regulates legal relations in the field of competition, including many groups of relations corresponding to specific groups of regulations such as: group of regulations on organizing and launching emulation movements; group of regulations on reward work; group of regulations on organizing the apparatus for competition work; group of regulations on handling complaints and denunciations in the implementation of competition law; group of regulations on competition fund management; group of regulations on processes and procedures in the implementation of competition law... However, within the scope of research, the thesis mainly focuses on analyzing the implementation of competition law for the following main groups of contents:

Firstly, implement the law on emulation and rewards in the organization, launch emulation movements.

In organizing and launching emulation movements, it is necessary to properly implement the contents of objectives, principles, and authority. Accordingly, Article 5 of the Law on Emulation clearly stipulates, " The objective of emulation is to create motivation, attract, and encourage all individuals and groups to promote the tradition of patriotism and dynamism.


Be proactive, creative, and strive to fulfill assigned tasks well, with the goal of a rich people, strong country, and a fair, democratic, and civilized society .

At the same time, THPL in competition must follow the principles of voluntariness, self-awareness, openness, solidarity, cooperation, and mutual development. The PTTDs are organized and launched in two forms: regular competition and periodical competition.

Emulation titles include: Emulation titles for individuals: "National Emulation Fighter"; "Emulation Fighter at the level of Ministries, branches, provinces, central mass organizations"; "Emulation Fighter at the grassroots level"; "Advanced Worker", "Advanced Fighter". Emulation titles for collectives: "Emulation Flag of the Government"; "Emulation Flag at the level of Ministries, branches, provinces, central mass organizations"; "Excellent Labor Collective", "Victory Unit"; "Advanced Labor Collective", "Advanced Unit"; Cultural Village, Hamlet, Hamlet, Residential Group and equivalent. Emulation title for households is "Cultural Family".

The awarding of emulation titles is based on the basis of emulation criteria, registration for participation in emulation, emulation achievements and emulation standards. Each type of emulation title is prescribed with specific standards, emulation achievements corresponding to the level of contribution to the common cause of the country, agency and locality. The authority to decide on the awarding of emulation titles is specifically stipulated in Articles 78, 79 and 80 of the 2003 Law on Emulation and Communism.

Second, implementing the Law on Labor in the implementation of the work of awarding labor contracts and technical assistance.

- The principles of THPL on rewards stipulated in the Law include (1) Accuracy, fairness, publicity and timeliness; (2) A form of reward can be given many times to one subject; (3) Ensuring consistency between the nature, form and subject of the reward; (4) Closely combining spiritual encouragement with material rewards.

Rewards must be based on the conditions, standards and achievements achieved, it is not necessary to officially reward at a lower level to be rewarded at a higher level. Focus on rewarding small collectives and individuals who are directly involved in labor, production, study, work or combat, combat service. Do not give many forms of rewards for one achievement. The form of reward in batches, topics is not considered as a condition, standard for proposing State-level rewards. When many individuals and collectives meet the conditions, standards, select female individuals or collectives with a female ratio of 70% or more for consideration for rewards. For female leaders and managers, the time holding the position to be considered for commendation for meritorious service is reduced by 1/3 compared to the general regulations; in cases where the retirement age is set higher, the time holding the position to be considered for commendation for meritorious service is implemented according to the general regulations ."

- According to the current Law on Economic Organization, there are 07 types of economic rewards including: Medals; Medals; State honorary titles; Ho Chi Minh Prize, State Prize; Commemorative medals, Badges; Certificates of merit; Certificates of merit. Corresponding to the 07 forms of rewards above, there are 29 different types, including 10 types of medals; 04 types of medals; 08 types of State honorary titles; 02 types of awards, 01 type of commemorative medal; 01 type of badge; 02 types of certificates of merit and 01 type of certificate of merit, specifically:

(4) "Ho Chi Minh Prize", "State Prize"; (5) Commemorative Medals, Badges; (6) Certificates of Merit including "Certificate of Merit from the Prime Minister" and "Certificate of Merit at the Ministerial level"; (7) Certificates of Merit.

The implementation of the Law on Economic Merit in considering and awarding rewards must be based on the reward criteria prescribed by law; based on the scope and level of influence of the achievements of the individuals and collectives proposed; and at the same time, linked to the responsibilities and specific circumstances in which those achievements were made. In particular, the reward criteria are prescribed for each form, type of reward, each level, each reward policy; corresponding to the achievements and the level of contribution and dedication to the common cause of the country, the agency and the locality.

Technical support: Based on each form, type of reward and achievement... The State stipulates the main technical support including: Regular rewards, periodic rewards (or by topic), unexpected rewards, rewards for the contribution process, rewards based on years of service, and external rewards.
