- Well implement the rights and obligations of employees in labor relations

Employees need to clearly understand their rights and obligations in the enterprise, which are: the right to sign a labor contract, in which they are paid in full according to the contract in accordance with the provisions of the law, depending on productivity, quality, work efficiency, overtime pay, etc.; be provided with labor protection equipment, work in conditions that ensure safety and hygiene; be entitled to leave according to the regime, take vacations, and holidays according to regulations, still receive salary and social insurance according to regulations. However, as analyzed in the current situation, through a survey of Japanese-invested automobile enterprises in Vietnam, up to 37% of employees do not clearly understand or do not pay due attention to the contents of the labor contract. This also means that employees do not care about or do not fully understand the contents of their rights and obligations in labor relations at the enterprise. In the context of competition in terms of human resource quality and job positions, employees need to be aware of this issue, need to understand more about the Labor Contract to ensure their own rights; at the same time, perform well their work obligations in the enterprise to avoid unfortunate consequences such as being taken advantage of, being taken advantage of and fired for violating regulations.

According to the current Trade Union Law, employees have the right to establish, join, participate in or even establish trade union activities. Employees in enterprises with FID investment capital also enjoy collective benefits, participate in enterprise management (on the basis of meeting appropriate standards and criteria of the Board of Directors) according to the enterprise's internal regulations and legal regulations, and have the right to strike according to the law. At the same time, employees have the obligation to implement the labor contract, collective labor agreement, comply with labor discipline, labor rules and implement the lawful management of the employer.

When they understand their rights and interests, employees will comply with and seriously implement the assignment of the enterprise; know how to protect themselves when their rights and interests are violated. In particular, it helps them know effective protection methods and know how to find solutions to resolve labor disputes, through legal regulations. Therefore, it is necessary to promote the role of the State, enterprises and trade unions in organizing the dissemination and propaganda of legal knowledge for employees so that employees understand and properly implement policies and laws. Employees need to actively play their role in direct production and grassroots trade unions participate in building policies and laws; increase exchanges and discussions between trade unions and union members and employees in the process of building

Workers need to practice to improve their sense of organization, discipline and industrial style in the enterprise.

Employees proactively pay attention to, learn about and improve their understanding of policies and laws. At the same time, actively participate in training and propaganda programs on policies related to labor issues organized by the Trade Union Executive Committee in coordination with employers. Voluntarily and strictly comply with policies and laws to work with high productivity and quality, contributing to improving the production and business efficiency of enterprises, creating jobs and stable income for employees in enterprises, creating harmonious, stable and progressive labor relations. Actively and proactively participate in union and enterprise activities to strengthen labor relations between employees and employers. Through a survey of Japanese-invested automobile enterprises in Vietnam, it shows that the majority believe that it is very necessary to have a trade union organization in enterprises (nearly 82%) to protect their legitimate rights. Thus, at the same time as the trade union organization must innovate and improve the quality of its activities, it is also necessary to have the cooperation of workers, in order to create a more "weighty" voice in the struggle and negotiation.

Negotiate with employers about labor laws, towards harmonious labor relations in enterprises.

For employees, studying to improve their qualifications is a condition to ensure stable employment and income, and at the same time an opportunity to change careers with better salaries and conditions. Studying helps employees understand more about social issues, especially their rights and obligations to better implement the contents of labor relations. Improve foreign language skills to meet job requirements in the process of industrial transformation.

Employees constantly self-study and improve their professional and technical skills such as: presentation skills, analytical skills, work handling skills, time management skills; read books, legal information, actively participate in union activities, social activities to improve understanding and effective cooperation spirit in performing tasks.

Workers must also proactively approach the 4.0 revolution, must see the 4.0 revolution as an opportunity instead of a challenge, constantly update and improve their working capacity and skills to gradually become friends with modern technology and machinery, master new technology and machinery. Especially for the automobile industry, which is the industry that applies the most achievements of advanced science and technology, workers need to have the ability to


ability to adapt to these changes to continue improving professional skills, increasing labor productivity, contributing to the development of enterprises in particular and the Vietnamese automobile industry in general in the new context.

Thus, promoting the spirit of self-study and self-training to master expertise, operate and use equipment well, ensure safety and efficiency, and learn to understand the language and culture of investment partners is a good opportunity to keep your job and increase your income.

4.3.6. Recommendations

- For the Party and State

To improve the quality of labor relations in foreign-invested enterprises in Vietnam in general and in Japanese-invested automobile manufacturing enterprises in particular, the Party and the State need to issue clearer guidelines and instructions in promoting labor relations in foreign-invested enterprises.

The State needs to increase investment in infrastructure, funding and improve the capacity and qualifications of the staff working in the field of law dissemination and propaganda, to form a legal consultancy system in localities. Diversify the forms and improve the quality of legal consultancy and legal aid for workers.

- For authorities

To regulate labor relations at Japanese-invested automobile manufacturing enterprises, authorities need to pay more attention to:

Issue and systematize Circulars, Decrees, and detailed guidance documents on the implementation of labor relations at foreign-invested manufacturing enterprises in Vietnam.

Create favorable conditions for foreign employers to access the Vietnamese legal system in international languages.

At the same time, organize inspection teams to monitor and inspect these enterprises. To ensure the quality and effectiveness of the inspections, the authorities need to issue strict sanctions and publicize the inspection results on mass media. Contribute to assessing the competitiveness of enterprises and ensuring the rights of consumers.


In fact, the capacity of the parties to the labor relations is still very limited compared to the development requirements of enterprises and the development speed of today's society. The cause of the above problems is that the understanding of labor laws of employers and employees in these FDI enterprises is not really good. Therefore, the authorities need to foster and raise the awareness and consciousness of employees and employers through propaganda programs, short-term training courses on labor relations; have tests, assessments and certifications for qualified people after training.

Issue a mechanism to protect union officials of FDI enterprises when performing their duties at enterprise unions so that grassroots union officials have sufficient capacity to represent and protect workers; help them enjoy their rights and obligations in a legitimate and legal manner to create a healthy and progressive labor relations environment; contribute to building and developing enterprises better and better.


Chapter 4 Summary

Actively studying the domestic and international context as well as the development trend of labor relations in Vietnam is extremely important in the current period of innovation. From there, quickly giving strategic directions to develop labor relations in Japanese-invested automobile manufacturing enterprises in Vietnam.

Based on the research, with the desire to contribute to promoting labor relations in these enterprises, NCS proposes a number of labor relations solutions such as: perfecting mechanisms and policies related to labor relations, proposing groups of solutions for the trade union system, organizations representing employers, employers, and groups of solutions with employees. The above groups of solutions are not separate but are unified with each other. Therefore, when implementing, it is necessary to closely and actively coordinate between groups of subjects and synchronize solutions. At the same time, NCS also makes a number of recommendations to the Party, the State and relevant agencies to promote labor relations in foreign-invested automobile manufacturing enterprises in general and those of Japanese investors in particular./.


CONCLUDE

In Vietnam in recent years, labor relations have become an issue of great concern to the Party, the State, domestic and foreign organizations, and enterprises. Because when the market economy is increasingly developing, economic sectors are born and develop strongly, making great and important contributions to economic growth, creating many jobs for employees. Labor relations are therefore increasingly diverse and rich.

In particular, labor relations in foreign-invested enterprises are becoming one of many sensitive issues; attracting the attention of both society and the subjects participating in labor relations. In the process of deep integration as today, foreign-invested enterprises, organizations representing employees and employers are facing great challenges to maintain and adjust healthy labor relations, build harmonious, stable and progressive labor relations.

Therefore, it is very necessary to grasp the content, nature, and identify the subjects when participating in labor relations... to have a correct view and assessment of labor relations in the country and in other countries in the world; to thereby create and strengthen the system of labor relations through mechanisms, policies, and agreements, and social DT is very necessary to ensure the legitimate rights and interests of employees; to thereby research and participate in building, improving, and enhancing harmonious, stable, and progressive labor relations. Subjects participating in labor relations have become more deeply aware of the importance of improving the quality of negotiations through agreements at FDI enterprises to develop production and business, improve labor productivity, and bring benefits to the parties participating in labor relations; as well as creating general stability for the whole society./.
