Thus, the current water quality of rivers and streams in Quang Ninh province has shown signs of pollution, some indicators exceed the allowable standards but the level of excess is not too large. Therefore, if pollution sources are controlled and treated according to technical procedures, the quality of surface water throughout the province will increase significantly, ensuring quality for water use needs and maintaining aquatic ecosystems.

3.4. Some issues on water resources management and protection in Quang Ninh province

3.4.1. Water resources management capacity at all levels, team of water resources experts

Currently, the function of water resource management has been transferred to the Ministry of Natural Resources and Environment, so in Quang Ninh province and other provinces, it also belongs to the Department of Natural Resources and Environment, while the Water Resources Management and Operation Companies in the provinces still belong to the Department of Agriculture and Rural Development of the province to manage and operate irrigation works in the province. The Department of Natural Resources and Environment has just taken on this function, so it has just begun to form its organizational structure and gather staff, so the implementation of this function is still very limited.

In the organizational structure of the Department of Natural Resources and Environment of Quang Ninh province, human resources for water resources management have been arranged under the Department of Water Resources Management - Hydrometeorology. The Department of Water Resources Management, Hydrometeorology of the Department of Natural Resources and Environment of Quang Ninh province currently has 6 staff members working to manage an area of ​​more than 6.1 thousand km2 . The staff of the Department have been trained and instructed on water resources management.

At the district and city levels, the Department of Natural Resources and Environment has been established, and the management of natural resources is assigned to the department, but most of them lack specialized staff. In particular, at the commune, ward and town levels of the province, there is a cadastral officer who is responsible for all four areas of natural resources and environment management.

In addition, in the province, there are a number of agencies and enterprises under the Department of Agriculture and Rural Development and the Department of Natural Resources and Environment directly involved in planning, surveying, designing, and managing the operation of water resources systems, including: Irrigation Sub-Department managing irrigation works; Irrigation Works Management and Exploitation Company managing the exploitation of irrigation works.

and provide irrigation and drainage services in the province; Water supply company provides water supply services to urban and rural areas.

3.4.2. Status of promulgation of legal documents on implementing State management of water resources in Quang Ninh province.

The Department of Natural Resources and Environment Management has advised the Provincial People's Committee to issue documents to support the management of natural resources in the province, such as: Regulations on Natural Resources Management in Quang Ninh Province issued together with Decision No. 1714/2009/QD-UBND dated May 29, 2009 and Decision No. 1697/2010/QD-UBND dated June 7, 2010 on amending and supplementing Clause 1 and Clause 2, Article 17 of Decision No. 1714/2009/QD-UBND. It states the rights and responsibilities of the state management agency on natural resources, the rights and obligations of the subjects in the regulations, regulations on licensing of natural resources activities and regulations on sanctions for violations in natural resources activities.

3.4.3. Guidance, propaganda and dissemination of laws on natural resources

In addition to issuing legal documents on water resources management, Quang Ninh province has also organized and implemented activities to guide, propagate and disseminate laws on water resources to localities and people such as: Organizing training courses to disseminate legal documents on environmental protection and water resources for the Department of Natural Resources and Environment of districts and towns; Handing over the Collection of legal documents on water resources provided by the Department of Water Resources Management to communes, wards and towns of Quang Ninh province.

3.4.4. Status of licensing on water resources

In recent years, the provincial Department of Natural Resources and Environment has participated in guiding units to prepare exploitation license dossiers, appraise and submit to the Provincial People's Committee to grant water exploitation and use licenses to units.

Receiving, appraising documents, submitting, extending licenses and monitoring and supervising the implementation process: Granting licenses for exploiting and using water resources; Granting licenses for discharging wastewater into water sources; Granting licenses for practicing underground water drilling; Renewing licenses for discharging wastewater into water sources.

Specifically, by 2012, there were 229 valid licenses in the province (Table 3.10). Of these, there were 120 licenses for wastewater discharge into water sources, 43 licenses for surface water exploitation, 63 licenses for underground water exploitation; 2 licenses for underground water drilling and 1 license for underground water exploration.

3.4.5. Status of inspection and examination of water resources

Every year, the Department of Natural Resources and Hydrometeorology Management coordinates with relevant units to conduct inspections of the following contents:

- Field inspection of water exploitation, use and wastewater discharge into water sources, monitoring of water environment sampling;

- Check, monitor water sampling, monitor flow and water level of the Investigation project;

- Monitor, inspect, supervise and urge consulting units to implement projects: Develop a plan for exploitation, use and protection of water resources in Quang Ninh province until 2020; Develop an action plan to respond to climate change in Quang Ninh province for the period 2010 - 2015, vision 2020; Search for groundwater for regional living; Investigate and evaluate the wastewater reception capacity of river water sources...

3.4.6. Evaluation of the effectiveness of water resources management in Quang Ninh province

3.4.6.1. Achievements in water resources management

In recent times, the management of water resources in the province has received more attention. The Department of Natural Resources and Environment has guided the preparation of dossiers for granting licenses for water exploitation and use for units. Appraisal and submission to the Provincial People's Committee for granting licenses for exploitation and use of water resources and discharging wastewater into water sources. Inspection, examination and punishment in the exploration, exploitation and use of water resources have also been carried out in recent times, contributing to limiting the phenomenon of indiscriminate exploitation of water resources.

In addition, most of the resolutions, documents and policies on the protection of water resources and the environment in Quang Ninh have been thoroughly grasped and implemented by all levels and sectors, especially at the provincial level. Through the results of the activities of the competent agency in the field of water resources protection, the Department of Natural Resources and Environment, it can be seen that many areas have been implemented and achieved good results. Examples can be taken in industrial parks, industrial production facilities, concentrated coal mining areas, etc.

In urban areas, water environment issues have been addressed through many activities such as providing clean water, collecting garbage and wastewater, periodically monitoring environmental quality, including air and water environments. Water quality monitoring activities at some lakes and rivers are maintained annually to assess water quality developments.

The coordination between the Department of Natural Resources and Environment with the Departments, Boards, Sectors and the Office of Natural Resources and Environment of districts and cities is maintained through the issuance and guidance on the implementation of legal documents and policies on the protection of local water resources and environment. Communication and education work has been strengthened over the years, contributing to raising environmental awareness among a segment of the population.

In production activities, the use of banned plant protection chemicals has been implemented quite effectively. People have increased the use of microbial fertilizers and plant protection chemicals that are less toxic to products and the environment.

Departments, Boards, Branches and local authorities have gradually recognized and identified their obligations in coordinating and participating in the work of protecting water resources and the environment.

3.4.6.2. Problems and difficulties in water resources management

- The implementation of resolutions and plans is still slow and lacks synchronization among localities during the implementation process, especially between rural and urban areas.

- The work of granting licenses for the exploitation and use of water resources and the discharge of wastewater into water sources is a newly implemented field, while water exploitation and wastewater discharge projects have been freely implemented for a long time. Therefore, water users and wastewater dischargers have not fully recognized their responsibilities and obligations in applying for licenses, and have been reluctant, procrastinating, and prolonged. Management agencies have had to urge them in writing many times;

- Inspection and examination of violations in the exploration, exploitation, use of water resources, and discharge of wastewater into water sources without a license are not really strong;

- Water resources monitoring and surveillance work has only been focused on a number of lakes, rivers, streams and areas with high levels of pollution such as industrial zones, mineral exploitation areas, etc., without paying attention to areas at risk of pollution such as rural areas that account for most of the province's natural area;

- Fields related to Water Resources Management are not closely coordinated;

- Documents on survey, investigation and assessment of water resources in the province are not yet complete and detailed;

- There is no data on basic investigation, assessment of quantity and quality of water resources at large scale to serve the management of exploitation licenses. There is a lack of specific information and data at a suitable level of detail to serve the work of consulting and directing. Regulations on water resources management according to river basins, in a comprehensive and sustainable direction, have not been developed and formed.
