According to the experience of countries that have implemented it, every 3 to 5 years, an inspector from one department will be rotated to another department and this experience should be applied in our country.

Conducting an inspection is the act of assigning the inspector the authority to perform his/her duties according to the inspection decision. Therefore, when exercising this authority, negative aspects may arise such as leniency towards the inspected subjects for their errors, even in cases of agreements that benefit both parties; improper handling of violations (punishing too severely or too lightly)... Therefore, it is necessary to have a mechanism to check and monitor the activities of inspectors to limit possible negative aspects by establishing internal inspection units, public inspection units or issuing a "cross-check" mechanism.

When the number of labor law violations in the inspector's area decreases, complaints and denunciations are resolved promptly and effectively, and strikes are limited, the inspectors in charge have a great contribution. 3.2.3. Improve the quantity and quality of inspectors and inspection officers

3.2.3.1. Increase quantity


The Department of Labor, War Invalids and Social Affairs is a multi-disciplinary department, but the number of inspectors is too small (309 people), so it cannot keep up with the management needs. This number of inspectors not only inspects the labor sector but also inspects other sectors and tasks of the department. Therefore, inspectors cannot proactively conduct inspections to prevent violations of labor laws, violations in the implementation of policies for people with meritorious services and social policies, and resolve complaints and denunciations within the scope of the department's management.

To carry out inspections by the current regional inspectors, it is urgent to increase the number of inspectors. Based on the division of regions, if there is not enough inspectors, it is impossible to carry out the division of responsibilities. According to the recommendation of the International Labor Organization, if the criteria for the number of workers in production establishments are taken into account, there are currently 3 levels of the number of workers to arrange 1 inspector: In developed industrial countries, the level should be arranged for 80,000 workers to have 1 inspector, in newly industrialized countries, the level should be arranged for 60,000 workers to have 1 inspector, and in developing countries, the level should be arranged for 40,000 workers to have 1 inspector [24]. We need about 1,000 labor inspectors (one inspector for every 40,000 workers), that is just in the labor sector alone. According to some studies, one inspector should be in charge of about 300 enterprises under normal conditions. In fact, in our country, the number of inspectors for labor inspection work is only about 50%, equivalent to 150 people. To meet the requirements of labor inspection work in general and inspection of the whole industry in particular, an urgent requirement is to improve the comprehensive capacity of inspectors and add more inspectors to match the assigned tasks.

At the same time, in addition to the field of labor inspection, the Inspectorate of Labor - Invalids and Social Affairs also inspects the implementation of policies for people with revolutionary contributions, social insurance policies, social protection, inspects basic construction, inspects public services and performs other tasks of the unit such as synthesis, administration, etc. Therefore, when adding the number of inspectors, it is necessary to take into account the number of inspectors to do these different jobs. The current number of inspectors of the Departments of Labor - Invalids and Social Affairs is 275 people, needing to increase by 211 people to a total of 486 people.

At the Ministry of Labor, War Invalids and Social Affairs, with a staff of 32 inspectors (of which 4 are in charge of management), on average, each province and city has only 0.4375 inspectors in charge. Therefore, it is necessary to allocate the number of inspectors reasonably and should be allocated by region, not by province or city boundaries. Each region has a group of 2-3 inspectors in charge of about 6-8 provinces and cities in a certain region. At the Ministry, the number of inspectors needs to increase by 16 people to a total of 48 people. For the inspectors of the General Department of Vocational Training, currently the whole country has about 1,500 vocational training establishments but only has 5 inspectors, it needs to increase by 5 more to a total of 10 people to be able to handle the task.


Regarding labor hygiene inspection, while the current number of inspectors has not been trained in this profession, the Ministry Inspectorate should recruit about 3-5 people who have professional qualifications in both theory and practice in labor hygiene to carry out the immediate tasks and act as "locomotives" to guide the number of labor inspectors working at the Ministry and localities nationwide. At the same time, the transfer of labor inspectors to other tasks should be minimized.

It can be said that the staff of the Labor, War Invalids and Social Affairs Inspectorate is still lacking in both quantity and basic knowledge of the areas that need inspection. Therefore, training and improving professional knowledge is one of the strategic and urgent tasks of the sector in the coming years.

3.2.3.2. Improve quality


Since the merger of inspection organizations under the provisions of the Labor Code, the Ministry Inspectorate and the Department Inspectorate have mainly performed separate inspection functions as before the merger. At the same time, because the function of labor hygiene inspection was transferred from the Ministry of Health to the Ministry of Labor, War Invalids and Social Affairs, but the number of labor hygiene inspectors was not transferred, inspectors from the Labor, War Invalids and Social Affairs sector had to perform this inspection work. Therefore, the requirement for labor inspectors is to be proficient in inspection work in terms of labor policies, labor safety and labor hygiene.

Improving the quality of labor inspectors is the training and supplementing of missing inspection knowledge so that inspectors can be confident in performing their tasks in all three areas above, for example, labor policy inspectors must be trained in safety inspection skills.


Labor and labor hygiene inspectors; labor safety inspectors are professionally trained in labor policy inspection and labor hygiene inspection, in which the immediate priority is training in labor hygiene inspection knowledge to gradually fill the "gap" in this extremely important field of work.

To meet the regional inspection method, inspectors must not only be good at labor inspection but also be professionally trained in the field of meritorious people and society, which is the work of inspecting the implementation of policies for meritorious people, inspecting the implementation of social insurance policies, preventing social evils and social protection. When assigned to be in charge of a region, the inspector must not only know how to inspect labor, labor safety or only know about the field of meritorious people and society, but that officer must know the inspection profession and have knowledge of all fields of the industry. In addition, the inspector must also grasp the professional work of finance, basic construction, handling complaints and denunciations, etc. This is a big challenge for the inspectors of the Labor - Invalids and Social Affairs sector. Although it is very difficult, the industry still has to do it.

Improving the quality of inspectors is not only about training and supplementing missing skills, but also about retraining inspectors by updating new information on the field of labor, war invalids and social affairs through annual inspection training programs, sending people to participate in the policy-making process, sending inspectors for training, refresher courses, and attending seminars and training sessions abroad.

Currently, we have a set of textbooks "Labor safety program and unified labor inspection system", the content of this set of textbooks is to train and retrain unified labor inspectors in all three areas.

In the long term, to meet the demand for quantity and quality of inspectors, opening the Faculty of Labor Inspection at the University of Labor and Social Affairs to train labor inspectors is an inevitable requirement.

3.2.4. Strengthening facilities, techniques and funding for inspection work

An inspector who wants to perform his duties well, in addition to good professional knowledge, must have adequate equipment to serve the work, especially in the field of occupational safety and hygiene inspection, which always requires accuracy and scientific basis. This is a very difficult job due to the limited state budget, but first of all, we must equip the requirements.

Transportation is part of the preparation for the inspection, it is necessary to ensure that the transportation is ready when needed. It is better for the inspector to have his own transportation or be provided with reasonable transportation arrangements. Because, when the inspector is not proactive in the means of transportation, he has to rely on the enterprise, and when going to the inspection facility, he has to rely on their help, and the inspector's mentality is to ignore it if the violation is not serious. At the same time, it also deprives the inspector of the ability to conduct an unannounced inspection. Careful preparation will increase the inspector's confidence when conducting the inspection.

3.2.4.2. Building and perfecting applied computer software


One of the important tasks of the Ministry Inspectorate is to direct and guide the professional work of the entire Labor - Invalids and Social Affairs sector's inspection system to collect statistics and analyze the situation of labor law violations and labor accidents nationwide, the situation of receiving citizens, handling petitions and resolving complaints and denunciations. Since 1996, the Safety Technical Inspectorate has developed software for collecting statistics and analyzing labor accidents; the Labor and Social Policy Inspectorate has developed software for resolving complaints and denunciations. The above software has made statistical work and work resolution quite convenient. However, due to being programmed for a long time and not being upgraded, the software is outdated, both in terms of programming language and the system of input and output criteria that need to be managed, so it does not meet current work requirements.

Like other state management agencies, to perform this function well, statistical analysis, data processing, forecasting, etc. are very important and require timely and accurate results. Currently, statistical and forecasting work is assigned by the Government.

Currently, the Inspectorate of Labor, War Invalids and Social Affairs is applying the inspection method of the Group to the inspectors in charge of the region with the construction, issuance, analysis, evaluation and processing of self-inspection forms on the implementation of labor laws at enterprises. However, to effectively deploy and implement this new method of operation, the Inspectorate of Labor, War Invalids and Social Affairs must develop software to process forms. This software will be applied uniformly from the Ministry Inspectorate to the Department Inspectorates nationwide. Only then will the analysis of forms be accurate, fast and recommendations will be made promptly to enterprises. On the other hand, the application of information technology will contribute to reducing the pressure on increasing the number of inspectors as it is now.

3.2.4.3. Ensure uniforms, inspector cards and other regimes


The provision of uniforms to enhance the status of inspectors when interacting with subjects has not yet been implemented. Therefore, in the coming time, there should be mandatory regulations on clothing for Inspectors of the Labor - Invalids and Social Affairs sector when performing their duties. At the same time, it is necessary to organize the timely issuance of labor inspector cards to ensure the legal basis for inspectors to operate. Preferential policies for inspectors are also an issue that needs to be addressed.
