CHAPTER V

SOCIAL INSURANCE ORGANIZATION MANAGEMENT




I. Social Insurance Organization:

- Social insurance organization is a career organization, with the function of implementing social insurance regimes and policies,

Manage and use social insurance funds according to the provisions of the Law on Social Insurance.

- The organizational structure and tasks of the Social Insurance Organization are prescribed by the Government.


II. Social Insurance Book:

- Social insurance books are issued to each employee to monitor the payment and enjoyment of social insurance regimes and are the basis for resolving social insurance regimes according to the provisions of the Law on Social Insurance.

- The Social Insurance Book form is regulated by the Social Insurance organization. And the Social Insurance Book is gradually replaced by the Social Insurance Card to simplify the Social Insurance review process.

- The social insurance organization is responsible for issuing social insurance books within 30 days from the date of receiving valid documents for participants in compulsory social insurance and unemployment insurance; 20 days from the date of receiving valid documents for participants in voluntary social insurance; in case of refusal, a written response must be given stating the reason.

III. Social insurance participation profile:

3.1. Compulsory social insurance participation documents include:


- Employee's personal declaration form according to the form prescribed by the social insurance organization.

- List of employees participating in compulsory social insurance by the employer

- Copy of the decision on establishment or business registration certificate or operating license for employers participating in social insurance for the first time; labor contract for employers who are individuals hiring or using labor.

3.2. Voluntary social insurance participation file : Personal declaration form according to the form provided by the insurance organization.

3.3. Unemployment insurance participation documents include:

- Personal declaration form according to the form prescribed by the social insurance organization

- List of employees participating in unemployment insurance prepared by the employer.

IV. Issuance of Social Insurance Book:

- Within 30 days from the date of signing the labor contract, work contract or recruitment, the employer shall submit the social insurance participation application to the social insurance organization.

- Social insurance organizations are responsible for issuing social insurance books:

+ Within 30 days from the date of receipt of valid documents for participants in compulsory social insurance and unemployment insurance.

+ Within 20 days from the date of receipt of valid documents from the insured

voluntary society


+ In case of refusal, a written response must be given stating the reason.

V. Social Insurance benefits file:

5.1. Sick leave benefit application:

- Social insurance book.

- Sick leave certificate for outpatient employees, hospital discharge certificate for inpatient employees at medical facilities, hospital discharge certificate or hospital consultation certificate for employees with illnesses on the list of illnesses requiring long-term treatment.

- Confirmation from the employer on working conditions for employees doing heavy, toxic, or dangerous jobs or occupations; regularly working in places with regional allowance coefficient of 0.7 or higher.

- Certificate from the employer on time off work to take care of a sick child, along with the child's medical certificate for employees taking time off work to take care of a sick child.

- List of sick leave and leave to take care of sick children prepared by the employer.


5.2. Maternity benefit application:

- Social insurance book.

- A copy of the birth certificate or a copy of the child's birth certificate or a death certificate in case the child or mother dies after giving birth.

In case a female employee goes for a pregnancy check-up, has a miscarriage, abortion, or stillbirth, the employee must have a certificate from a competent medical facility to apply contraceptive measures; the employee who adopts a child under four months old must have a certificate according to the provisions of law.

- Confirmation from the employer on working conditions for employees doing heavy, toxic, or dangerous jobs or occupations; working in three shifts; working regularly in places with regional allowance coefficients of 0.7 or higher, or confirmation from the employer for female employees who are disabled.

- List of beneficiaries of maternity benefits prepared by the employer.


5.3. Records for occupational accident benefits:

- Social insurance book.

- Minutes of investigation of work accident. In case of traffic accident determined to be work accident, there must be an additional copy of the Traffic Accident Minutes.

- Hospital discharge papers after treatment for work accident.

- Minutes of assessment of the level of reduced working capacity by the Medical Assessment Council.


- Document requesting settlement of occupational accident regime.


5.4. Occupational disease benefit records:

- Social insurance book.

- Minutes of environmental measurement containing toxic elements. In case the minutes are determined for many people, each worker's file must have a copy.

- Hospital discharge certificate after occupational disease treatment. In case of not being treated at the hospital, an occupational disease examination certificate is required.

- Minutes of assessment of the level of reduced working capacity by the Medical Assessment Council.


- Document requesting settlement of occupational disease regime.


5.5. Records for receiving health care and rehabilitation benefits:

- List of people who have received benefits for sickness, maternity, work accident, occupational disease

but poor health established by the employer.


- Document requesting settlement of health care and rehabilitation allowance.


5.6. Pension records for compulsory social insurance participants:

- Social insurance book.


- Decision to quit job for those who are paying social insurance; application for pension for those who reserve social insurance payment period.

- Minutes of the assessment of the level of reduced working capacity by the Medical Assessment Council for

with retirees as prescribed in Article 51 of this Law.


5.7. Death benefit application file for compulsory social insurance participants:


5.7.1. Death benefit records for people paying social insurance and people

Reserving social insurance payment period includes:

- Social insurance book;


- Death certificate, death notice or court decision declaring death;

- Declaration form of relatives according to the form prescribed by the social insurance organization;

- Minutes of investigation of occupational accidents, medical records of treatment of occupational diseases in case of

death from work accidents, occupational diseases


5.7.2. The death benefit file for a person receiving monthly pension, occupational accident and disease allowance with a working capacity reduction of 61% or more includes:

- Death certificate, death notice or court decision declaring death;

- Relatives' declaration form according to the form prescribed by the social insurance organization.


5.8. Records of pension, one-time social insurance, death benefits for participants

voluntary social insurance:

5.8.1. The dossier for receiving pension and one-time social insurance includes:

- Social insurance book;


- Personal declaration form according to the form prescribed by the social insurance organization.


5.8.2. The death benefit application file includes:

- Social insurance book for people paying social insurance;

- Death certificate, death notice or court decision declaring death;

- Relatives' declaration form according to the form prescribed by the social insurance organization.
