Scope of Assessment of Current Status of Customs Procedures for Import and Export Goods by Sea in Ho Chi Minh City


- Enterprises carrying out customs procedures will be supported by customs agencies with training, provided with customs declaration software and free direct consultation.

- Enterprises can choose the form of fee payment (monthly or per declaration) instead of only being able to pay per declaration as in traditional customs procedures.

- Liquidity records for processing contracts and importing raw materials for export production are simpler. Instead of having to submit or present declarations, liquidity reports and paper documents, enterprises can use electronic records for liquidity.

- Enterprises can register to carry out customs procedures at any Customs Sub-Department and be accepted to carry out customs procedures at other Sub-Departments instead of having to register at each Customs Sub-Department as before.

- Implementing e-customs procedures helps businesses reduce time and costs of customs procedures because businesses can be proactive in the customs declaration process and arrange time to receive and export goods.

For customs authorities:

Electronic customs procedures help customs agencies become more transparent and professional, meeting the requirements of development, modernization, and integration with the region and the world; creating many advantages in production and business activities and enhancing economic potential for enterprises. Initially, a team of officials and civil servants at provincial and municipal customs departments with skills and knowledge to perform electronic customs procedures has been formed, creating a premise for the implementation of expanding customs procedures deeply and widely in the coming period.

 The implementation of e-customs procedures clearly demonstrates the determination to innovate, reform administrative procedures, and change the management methods of the Ho Chi Minh City Customs Department in particular and the customs sector in general. Applying the risk management method based on modern equipment to replace the traditional manual management method. Switching from pre-inspection, inspection during customs clearance (pre-inspection) to KTSTQ (post-inspection), creating favorable conditions for enterprises in quickly releasing goods.

 The implementation of the Customs procedures and the establishment of the Customs Sub-Department has partly reduced the work pressure for the Customs Sub-Departments. All work is processed through the computer system, helping to manage effectively and scientifically; limiting contact between enterprises and customs agencies and limiting negative situations from occurring.


 With a compact organization, simple procedures, and less use of paper documents, a customs official can handle many different tasks. Through the system, the professional stages are carried out sequentially, saving time in circulating and signing documents. Therefore, the time for customs clearance of goods is faster than the traditional manual process.

 Ensure publicity, transparency and fairness in management. All information required by the customs authority for enterprises is displayed on the system, helping enterprises to be proactive in completing procedures, limiting the need to travel many times, causing inconvenience to enterprises.

 Building a good image of the HQ agency in terms of modern facilities and equipment, civilized and polite working style, attitude and spirit of serving enterprises in import and export activities.

 The initial successes of implementing the E-customs procedures at the unit are the premise for developing the E-customs procedures in the future. Thereby, the Ho Chi Minh City Customs Department and the General Department of Customs have drawn many experiences in directing the implementation of the E-customs procedures in the past, orienting the E-customs work in the coming time, successfully implementing Decree No. 222/2009/TT-BTC dated November 25, 2009 of the Prime Minister and creating motivation for the reform and modernization of E-customs procedures. This is also the premise and experience for implementing the E-customs modernization project under the World Bank loan capital later.

For society:

 This is an important event that receives special attention from the Government, ministries and branches and the support of the business community and society.

 Is one of the outstanding events in 2005 that a number of newspapers voted (voted by the Ministry of Trade, Viet NamNet electronic newspaper and FPT company as one of the 10 commercial events in 2005).

 Building a customs force that is professional, specialized, equipped with modern equipment and techniques, operating effectively and efficiently, contributing to facilitating legal trade activities, developing tourism, attracting foreign investment, ensuring national security, social safety, protecting national interests, and the legitimate rights and obligations of organizations and individuals.


2.4. Scope of assessment of the current status of customs procedures for import and export goods by sea in Ho Chi Minh City

The thesis focuses on investigating the current status of the H QĐT procedure in Ho Chi Minh City through a questionnaire survey at enterprises currently performing this service in Ho Chi Minh City in 2011.

The expansion of electronic customs procedures has brought practical benefits to businesses, meeting the requirements for administrative procedure reform under the direction of the Prime Minister. The customs clearance time for shipments implementing electronic customs procedures has been significantly reduced compared to conventional procedures and remote declaration; the list of documents in the electronic customs dossier has been significantly reduced compared to traditional customs procedures. Through surveys and consultations with provincial and municipal customs departments, most businesses agree and support the policy of expanding electronic customs procedures and highly appreciate this method.

CHAPTER 3:

INVESTIGATION OF ELECTRONIC CUSTOMS PROCEDURES FOR IMPORT AND EXPORT GOODS BY SEA THROUGH ASSESSMENT AT COMPANIES WITH IMPORT AND EXPORT ACTIVITIES AND PROPOSAL OF IMPROVED SOLUTIONS


3.1. Activities to implement customs procedures for import and export goods by sea in Ho Chi Minh City

3.1.1. Implementation procedures

Due to time constraints, the thesis only introduces the process of implementing electronic customs procedures for export and investment goods by sea in Ho Chi Minh City.

3.1.1.1. Prepare and check documents

In case of exporting goods under CIF conditions, the customs clearance staff will contact the shipping line to get the booking and know the date, time, port of departure, and ship name. At the same time, contact the insurance company to buy insurance according to the customer's request.

For export goods, the customs declaration dossier includes:

Paper form of customs declaration registration receipt & online registration declaration receipt.

Export Customs Declaration HQ/2009-TKĐ TXK (2 originals)

Customs declaration appendix (if any)

Foreign trade contract (1 copy)

Export Consignment Contract (if any - 1 copy)

Commercial Invoice & Packing List (1 original and 1 copy)

Company introduction letter

Export license (if any)

Animal/plant quarantine registration certificate (if the shipment requires quarantine - 1 copy)

The document staff must check the consistency between the information on the document. Normally, the following information is checked (information used for making declarations and doing customs procedures):


- For foreign trade contracts: Contract number, date of signing the contract, name and address of the seller, name and address of the buyer, name of goods, quantity, unit price, total value, terms and conditions of delivery, origin of goods, payment method.

- For Commercial Invoice: Invoice number, invoice date, seller's name and address, buyer's name and address, goods name, quantity, unit price, total value, delivery terms and conditions, payment method to see if they are compatible with the information on the contract or not.

- For Packing List: check number of packages, weight, volume

When detecting any confusion between the above information, the document staff must immediately notify the customer so that they can make adjustments. Then proceed to register the declaration on the electronic software.

+ In case the customer signs an export entrustment contract with the company, requesting the company to arrange all export procedures on their behalf, they will not make an Invoice, Packing List but only send details of the shipment for the company's document staff to help, usually these 2 documents will be combined into an " Invoice & Packing List " showing full information about quantity, unit price, number of packages-signatures-volumes. And at this time, the Export Entrustment Contract is attached to the Customs Declaration Documents.

+ In case the company acts as a Customs Clearance Agent, the " Customs Clearance Agent " section will be shown on the Invoice & Packing List and a Customs Clearance Agent Contract will be included in the Customs Clearance Documents.

3.1.1.2. Transmit customs declaration data online, create export customs declarations and prepare customs declaration documents

Prepare electronic customs declaration for export.

Actual steps to declare customs on computer:

Document staff enter the online declaration software (ECUSK 2_KD - Electronic Custom Service) provided by the Data and Information Technology Center of Ho Chi Minh City Customs Department to enter export customs declaration data. Entering criteria on the declaration software is similar to entering information on a paper declaration. After entering, with just a simple operation, the data will be transmitted to the customs branch where we open the electronic declaration. ECUS software


It supports the function of printing the entered information onto the paper declaration form. The printed information is very accurate and beautiful, much more convenient than the manual method as before.

Electronic customs declaration includes the following steps:

When starting the program you must perform the login function (LOG IN). Please enter full access parameters:

+ Username : sa

+ Access code : your password to access the program

+ CSD Name L : ECU S

+ Server name : The name of the server containing the MS SQL Server database is usually the name of the computer running the program.

+ Customs unit : name of the Customs unit receiving the electronic declaration (here is the Customs Sub-department managing investment goods)

Once you have entered all the information, select the “ Login ” button. If you cannot log in, please check all the parameters you entered and log in again.

Step 1. Create electronic customs declaration

- Go to the program menu and select the function: " Application form/Register new export declaration ". Then the screen will display the function "Enter new import declaration " .

- After filling in the necessary information on the " Declaration information" tab , select the " Declaration goods list" tab and fill in all the information about the goods you want to import. When you have filled in all the information, select the " Record " button.


- In addition to fully declaring information on the declaration form, businesses are required to declare additional accompanying documents such as: contract, invoice, packing list, bill of lading, license (if any), etc.


Step 2. Declare electronic declaration

- Submit declaration to e-Customs.

- To prepare to send the declaration to Electronic Customs, your computer must be connected to the INTERNET.

- You select the " Declare " button on the second sheet entry screen. If you have not entered your login name and password to connect to VAN, the screen will appear for you to enter your login name and password to connect to VAN.

- After entering, select the accept button. Then wait a moment to receive preliminary return information from the e-Customs such as declaration number,...

When the Customs System receives the receipt number, the electronic declaration submission step is complete.


Step 3. Receive the results of the electronic declaration


The customs officer will process the declaration and respond with the results. Based on this response, the enterprise will proceed according to the instructions of the responded results.

- In case the enterprise declares incorrectly or the documents are unclear, the customs authority will send a response requesting the enterprise to supplement and adjust. After adjusting, the enterprise will re-submit the declaration to get a new receipt number;

- In the declaration of electronic customs procedures, there is a section for scanning attached documents. Only when the customs authority requests the enterprise to scan, the enterprise will scan and attach it to the declaration and send it back, note that the file size to be scanned must not exceed 2M b).

Step 4. Check and process the declaration

After having the declaration number, the enterprise waits for the response from the customs authority to see the declaration classification results. Customs procedures are divided into 3 main streams: green, yellow, red.
