SUMMARY OF CHAPTER III

Given the development trend of society and the practical situation of law enforcement of private hospitals, it is necessary to perfect the legal system on the organization and operation of private hospitals. In the direction of perfecting the law, it is necessary to meet the requirements of administrative procedure reform, synchronize with the medical law system, create an equal business environment, a civilized medical environment. The law on private hospitals is regulated by the Enterprise Law, Investment Law, Medical Examination and Treatment Law, Health Insurance Law and other relevant legal documents. However, the current law on private hospitals still has many shortcomings, is not unified, synchronized, the regulations still place private hospitals as a normal business entity, regulate private hospitals as a normal hospital without a separate legal system for this special entity. Therefore, the law needs to be amended, supplemented, and perfected to suit the practical situation. To perfect the law on private hospitals, we must first review the regulations on private hospitals, identify the advantages and disadvantages of the legal regulations, and on that basis propose solutions to perfect the law on the organization and operation of private hospitals in Vietnam today.

CONCLUDE

Over the past years, from the implementation of the policy of socializing healthcare, a series of private hospitals have been established across the country, providing many medical service options for people. Private hospitals have been established to meet the needs of high-quality medical examination and treatment of people and play an important role in reducing pressure on public hospitals.

The formation of a private hospital is also the formation of a special entity with mixed characteristics between an economic unit and a community-based unit. In order for private hospitals to operate effectively, develop both in quantity and quality, and fulfill their roles and tasks well, there must be specific, clear, supportive, and preferential legal regulations for this special entity.

Because private hospitals are special entities, the law on hospitals also has special characteristics, both the nature of an enterprise and the nature of social welfare. Up to now, the regulations on private hospital law have basically created a specific legal corridor for hospital operations. In addition, it has initially created a driving force for development and increased the responsibility of private hospitals before the law. However, because private hospitals were formed late, the law on private hospitals still has shortcomings and limitations. Through research and analysis of legal regulations, research on the practical implementation of the law of private hospitals, and inspection and examination work of state agencies, it is possible to point out legal regulations that need to be adjusted. Based on that, propose solutions to improve the law on private hospitals.

From the study of the law on private hospital organization, it is seen that the State needs to pay more attention to this special subject, needs more policies, regulations, and support in the process of establishment and operation, needs to have an objective, correct, and complete view of the role of private hospitals in the health system and needs to have more fairness in operation compared to public hospitals.
