Relevant agencies and organizations are responsible for responding to such petitions within 7 days from the date of the decision to resolve them.

Article 92

The Government, the Supreme People's Court, and the Supreme People's Procuracy periodically notify the Central Committee of the Vietnam Fatherland Front; People's Committees, People's Courts, and People's Procuracies at all levels periodically notify the Fatherland Front Committees at the same level about the work of handling complaints and denunciations.

1- The People's Inspectorate, within the scope of its duties and powers, receives information and feedback from the people on complaints and denunciations and resolves complaints and denunciations at communes, wards, towns, agencies and grassroots units; promptly detects violations of the law on complaints and denunciations; recommends the Chairman of the People's Committee at the commune level, heads of agencies and grassroots units to promptly and legally resolve complaints and denunciations and supervise such resolution.

Article 94

Relevant agencies, organizations and individuals are responsible for creating conditions for the Vietnam Fatherland Front Committee, member organizations of the Front, and People's Inspectorate organizations to supervise the implementation of laws on complaints and denunciations.


CHAPTER VIII

REWARDS AND HANDLING OF VIOLATIONS


Article 95

Agencies, organizations and individuals with achievements in resolving complaints and denunciations, and whistleblowers with achievements in preventing damage to the State, organizations and individuals shall be rewarded according to the provisions of law.


Article 96

If a person handling complaints or denunciations commits one of the following acts, depending on the nature and severity of the violation, he/she shall be subject to disciplinary action or criminal prosecution; if causing damage, he/she must compensate according to the provisions of law:

1- Lack of responsibility in handling complaints and denunciations;

3- Intentionally delaying the settlement of complaints and denunciations;

Article 97

Citizen receptionists who commit one of the following acts shall, depending on the nature and severity of the violation, be subject to disciplinary action or criminal prosecution:

1- Lack of responsibility in receiving citizens;

2- Causing trouble, harassment or obstruction of people from presenting complaints, denunciations, recommendations or reflections;

3- Violation of rules and regulations on citizen reception;

4- Failure to promptly process or falsify information and documents provided by complainants, denouncers, petitioners, and reflectors;

5- Violating other provisions of law on citizen reception.

Article 98

Persons responsible for implementing decisions on complaint settlement and denunciation handling, if failing to do so, shall, depending on the nature and severity of the violation, be subject to disciplinary action, administrative sanctions or criminal prosecution; if causing damage, they must compensate according to the provisions of law.


Article 99

Heads of competent agencies and organizations who fail to apply necessary measures to promptly handle individuals who violate the provisions of Articles 96, 97 and 98 of this Law shall, depending on the nature and seriousness of the violation, be subject to disciplinary action or criminal prosecution in accordance with the provisions of law.


Article 100

Anyone who commits one of the following acts shall, depending on the nature and severity of the violation, be subject to disciplinary action, administrative sanctions or criminal prosecution; if causing damage, compensation must be paid in accordance with the provisions of law:

1- Inciting, coercing, enticing, or bribing others to make false complaints or accusations;

2- Taking advantage of complaints and denunciations to distort, slander, disrupt order, and cause damage to agencies, organizations, and individuals;

3- False accusation;

4- Threat, revenge

5- Violating other provisions of law on complaints and denunciations.


CHAPTER IX

TERMS OF IMPLEMENTATION


Article 101

Complaints and settlement of complaints by foreign individuals, agencies and organizations, and denunciations and settlement of denunciations by foreign individuals in Vietnam shall be applied according to the provisions of this Law, except in cases where international treaties to which the Socialist Republic of Vietnam is a signatory or participant have other provisions.


Article 102

The Government shall detail and guide the implementation of this Law; based on this Law, other State agencies, political organizations, and socio-political organizations shall guide the implementation of the law on complaints and denunciations within the scope of their agencies and organizations.


Article 103

This Law comes into force from January 1, 1999.

The Ordinance on Citizens' Complaints and Denunciations dated May 7, 1991 ceases to be effective from the effective date of this Law.

Previous regulations contrary to this Law are hereby repealed.

This Law was passed by the 10th National Assembly of the Socialist Republic of Vietnam, 4th session, on December 2, 1998.
