Note : The depreciation period specified above is used for calculation in BIDV's appraisal work and is the maximum time for 100% new machinery and equipment. Depending on each specific case, BIDV applies an appropriate value, ensuring competitiveness and risk management requirements.
Appendix III/Fixed Assets
DISBURSEMENT PRINCIPLES FOR SPECIAL CASES
1. For investment in construction of headquarters, factories, canteens, and rest houses (excluding land use rights value).
In case the real estate (construction works) is a mortgaged asset formed in the future, disbursement will only be made when the customer has a Construction Permit (except in cases exempted by law) and presents documents proving the completed construction and installation volume (Construction and installation contract, Equipment supply contract, Minutes of confirmation of completed construction and installation volume, VAT invoice...). In case the documents proving the completed construction and installation volume cannot be presented, disbursement will only be made when the customer has a Letter/Contract of Guarantee for Advance Refund or a Letter/Contract of Guarantee for Contract Performance issued by a credit institution with the Guaranteed Party being the partner performing the Construction/Installation Contract and the Beneficiary of the Guarantee being the customer.
2. For means of transport/motor vehicles and used assets
The branch shall disburse the loan after checking the actual condition of the means of transport/motor vehicle and the customer has completed the following procedures: (i) registering the means of transport/motor vehicle in accordance with the law; (ii) purchasing insurance and confirming the transfer of the right to benefit from physical insurance to BIDV if the Contract/Application/Certificate of Insurance does not specify that the first benefit belongs to BIDV; (iii) handing over the original Certificate of Registration (in mandatory cases or cases where the customer agrees to let BIDV keep the original) or the Appointment Note for returning the registration result. In addition, depending on each specific case, the Branch shall perform as follows:
a) For assets purchased domestically:
- The Business Management Department needs to verify the qualifications of the Seller before disbursing if there are signs of risk or there is too little information about the Seller on the market. Note that in case the customer buys property from an individual, the Documents/Contract for the sale of property must be notarized in accordance with the procedures prescribed by law. At the same time, coordinate with the customer to complete the procedures for registration of ownership or registration of transfer of ownership.
Change ownership of assets according to regulations, ensure to import new original documents on ownership of assets. Encourage disbursement after customers present VAT invoices.
- For registered means of transport/motor vehicles, the Business Management Department is responsible for collecting information related to the ownership of the vehicle (chassis number, engine number, paint color, vehicle type, photocopy of the Vehicle Registration Certificate) to determine the legality of the new registration with the competent State agency (currently the local Traffic Police Department) and only disburse when verifying that the transfer of ownership is legal and valid.
- In case the Seller of the means of transport/motor vehicle agrees to receive payment after the customer receives the vehicle and completes the registration procedures, the Branch must send a Notice of approval of the loan amount (refer to Form No. 05/TSCĐ) to the Seller and coordinate with the customer to complete the procedures for transferring ownership and mortgaging assets before disbursing payment.
- In case the Seller of the means of transport/motor vehicle requires payment before the customer receives the asset, after signing the Credit Contract and before disbursement, the Branch shall request the Seller to transfer to the Branch and the customer (both Parties receive and hand over to the Branch for safekeeping) all original documents proving ownership such as: Registration Certificate and Inspection Book (if the asset is used); vehicle/motor vehicle records (Customs declaration (if the asset is imported) or Factory Quality Inspection Certificate (if the asset is domestically manufactured or assembled); Sales contract, VAT invoice) - if the asset is 100% new or used but imported for the first time).
After disbursement, the Branch will coordinate with the customer to complete the procedures for name change, change of ownership (if any), pay registration fees, register, and purchase insurance. At the same time, it is responsible for keeping the Appointment Paper for returning the results of vehicle/motor vehicle registration. In all cases, the Branch is responsible for continuously monitoring the collateral during the time of completing the procedures for issuing the Certificate of Automobile Registration. At the appointment paper for returning the results of registration, the Branch will coordinate with the customer to receive the Certificate of Vehicle/motor vehicle registration (the Branch will keep the original Certificate).
Register after the police agency hands over to the customer (in mandatory cases or cases where the customer agrees to let BIDV keep the original) or keep a certified copy according to the law (in cases where the customer does not agree to let BIDV keep the original).
b) In case of import from foreign countries:
Disbursement is in accordance with the payment method of the Import Contract according to BIDV's general regulations.
