- Land for perennial crops in 2016 was 19,431.71 ha compared to 19,613.40 ha in 2017, an increase of 181.69 ha, due to the following types of land being converted: rice land; annual crop land; production forest land, protective forest land; unused flat land; unused hilly land.
b) Forestry land increased by 3,520.18 ha (in Muong Ang, Muong Lay, Dien Bien Dong, Muong Cha districts), including:
- Production forest land increased by 210.27 ha, due to the following types of land being converted: land for growing other annual crops, protective forest land, and unused hilly land.
- Protective forest land increased by 3,311.47 hectares, due to the change of land use purposes of other types of land, including: Land for growing other annual crops, protective forest land, aquaculture land, and unused hilly land.
c) Aquaculture land increased by 3.56 ha; due to the transfer of rice land, land for other annual crops, land for perennial crops, land for non-agricultural production and business, and unused hilly land.
d) Other agricultural land remains unchanged.
Changes in area of non-agricultural land group:
Non-agricultural land increased by 214.56 hectares, mainly in land used for public purposes. Specifically as follows:
a) Residential land increased by 6.92 ha;
- Urban land increased by 1.38 hectares.
- Rural land increased by 5.54 hectares.
b) Specialized land increased by 211.96 ha. Of which:
- Land for building agency headquarters increased by 7.18 hectares.
- National defense land increased by 7.84 hectares (Na Bung border post - Nam Po district, Ban Ban training ground - Muong Ang district) .
- Land for construction of public works increased by 4.58 hectares.
- Non-agricultural production and business land increased by 2.59 hectares.
- Land used for public purposes increased by 189.77 hectares.
c) Cemetery land increased by 0.61 ha.
d) Land of rivers, canals, ditches and streams decreased by 4.92 ha.
Unused land movement:
Unused land: 193,634.41 ha, down 5,983.05 ha. The main reason is due to the change of land use purpose to other types of land, such as: Protective forest land, production forest land, residential land, land used for public purposes,...
- Unused flat land 669.52 ha decreased by 1.39 ha.
- Unused hilly land 191,202.47 ha, decreased by 5,981.66 ha.
- 1,762.42 ha of unforested rocky mountain remains unchanged.
Assessment of land fluctuations from December 31, 2016 to December 31, 2017:
- The situation of land change management has been updated and managed more and more strictly, legally and effectively, contributing to promoting economic development, maintaining political and social stability of the locality. The data on the area of land types that have changed is determined based on the results of the implementation of the work of changing land registration, land allocation, land recovery, land lease, land use purpose conversion and the results of cadastral measurements in the field in recent years. Specifically:
+ Agricultural land group: The area of this group increased mainly in forestry land area.
+ Non-agricultural land group: The area of this group increases mainly for public land purposes, construction of infrastructure, industrial production and service facilities according to land use planning and plans.
+ Unused land group: The area of this group has decreased mainly due to the conversion to agricultural and non-agricultural land groups.
- Through annual land statistics, it has also reflected the work of updating and managing land fluctuations more and more closely and gradually entering the system.
However, there are still some limitations in land use management such as: updating and adjusting land changes at the commune level is not regular; land use for the wrong purpose, encroachment, and land disputes still occur; recovery, compensation, and site clearance for socio-economic development projects in cases where the State recovers land are still slow. Land management in some communes at some times has not been focused on, most of the commune cadastral officers are not proficient in using specialized software, especially land statistics software. The progress of reporting and annual land statistics is still slow, not ensuring the prescribed time.
- The main reason for the above shortcomings is that the land management work of commune-level authorities in some localities is still not resolute; the propaganda and dissemination of land laws and policies to the people have not been done well; some professional staff in charge of land management and monitoring at grassroots authorities are still weak in professional capacity, especially the team of communal cadastral officers; basic investigation documents such as cadastral maps are still lacking and of poor quality due to not being regularly adjusted and updated, which has significantly affected the land management work at the grassroots level. On the other hand, due to the limited provincial budget, the funding source for land surveying and records creation is still lacking, which partly affects the effectiveness of land management and use.
3.3. Evaluation of the results of land use rights mortgage at the Bank for Agriculture and Rural Development of Vietnam, Dien Bien province branch
3.3.1. Procedures for mortgaging land use rights of the Bank for Agriculture and Rural Development of Vietnam, Dien Bien province branch.
At the Vietnam Bank for Agriculture and Rural Development, Dien Bien province branch, when accepting mortgages on land use rights, house ownership rights and assets attached to land, the following steps must be taken:

At the Vietnam Bank for Agriculture and Rural Development, Dien Bien province branch, when accepting mortgage of land use rights, house ownership rights and assets attached to land, the mortgagor must prepare a set of documents to submit to the bank including the following papers:
- Loan application form provided by Vietnam Bank for Agriculture and Rural Development, Dien Bien province branch.
- Identity documents include: Citizen ID card/National ID card, household registration book/passport...
- Temporary residence certificate if not living at the address in the household registration.
- Documents proving the purpose of the loan.
- Documents proving monthly income, if there is no salary statement, you can use the most recent 3-month electricity bill with appropriate value.
- Documents on collateral owned by the contract holder.
To receive a loan, you need to wait for your application to be approved and wait about 7-10 days for the bank to disburse.
Procedures for mortgaging land use rights at the Bank for Agriculture and Rural Development of Vietnam, Dien Bien province branch:
Step 01: Assessment
- Bank appraises the value of collateral
- And survey the actual housing situation, job, business situation of the Borrower.
Step 02: Review
- Based on the appraised value of the property, plus the results of the actual survey,
- Staff prepares customer appraisal report and submits to Credit Department
- Either the Credit Council or the Authority that decides on the loan/from
refuse loan
Step 03: Notarize mortgage and register secured transaction
- Bank and customer sign notarized mortgage contract
- The customer hands over the Land Use Rights Certificate or the Certificate of Land Use Rights, House Ownership Rights and other assets attached to the land to the bank staff to carry out the registration procedures at the Department of Natural Resources and Environment.
Step 04: Bank disburses and provides additional documents proving loan purpose
- After the mortgage registration result (also known as secured transaction registration) is available, the Bank will contact the land use right mortgagor to receive the disbursement.
- Customers present documents proving the purpose of the loan such as:
+ Buying a house requires a notarized sales contract, buying business goods requires invoices and economic contracts,
+ To build a house, you need a building permit, construction contract, construction estimate, etc.
3.3.2. Results of mortgage of land use rights of the Bank for Agriculture and Rural Development of Vietnam, Dien Bien province branch.
3.3.2.1. Purpose of mortgaging land use rights at the Bank for Agriculture and Rural Development of Vietnam, Dien Bien province branch.
When there is a need to mortgage land use rights to borrow capital from a bank, the first thing a credit officer does when contacting and completing the application is to ask people to answer the question: What is the purpose of borrowing money? Ensure that the purpose of borrowing capital is not contrary to the provisions of law. When the bank has decided to lend, the bank credit officer continues to ask the customer to prove
proving the purpose of using the loan. Thus, it can be seen that the purpose of mortgaging land use rights in people's loan needs is relatively important, it is considered a premise for their mortgage loan proposal at the bank.
Up to now, the Vietnam Bank for Agriculture and Rural Development, Dien Bien province branch, has 5 main lending purposes for customers as follows: Loans to buy real estate, loans to build and repair houses, loans to buy cars, loans for business, other purposes (buying machinery, equipment, etc.)
Customers can make their own choices after being consulted by staff about loan packages, control their financial capacity and options, loan packages, and loan terms according to their needs after being carefully consulted by staff.
During the process of customers using loan capital when mortgaging land use rights at the Vietnam Bank for Agriculture and Rural Development, Dien Bien branch, bank staff will conduct inspections and monitor the use of loan capital to assess whether the borrower is using the loan for the right purpose as agreed in the loan contract or not. Normally, the bank will conduct periodic inspections and require the borrower to provide some documents and certificates such as invoices, delivery notes, goods/assets lists, warehouse receipts, signed payrolls, etc.
