limitations of the criminal code, of state management, and from lack of vigilance, thereby creating loopholes that criminals exploit to commit crimes.
The content of the thesis analyzed the concept and legal signs of the crime of fraud and appropriation of property, assessed the current situation of investigation, prosecution and trial of this crime in the 5 years from 2008 to 2012 in Nam Dinh province, analyzed the limitations associated with the characteristics of Nam Dinh province and proposed some measures to improve the Penal Code on the crime of fraud and appropriation of property and improve the effectiveness of applying the provisions of the Vietnamese Penal Code on the crime of fraud and appropriation of property in particular.
To improve the effectiveness of the application of the provisions of the Penal Code on fraud crimes in Nam Dinh province in particular and the whole country in general, it is necessary to apply a comprehensive set of general and specific measures such as: further strengthening the effectiveness of state management of security and order, closing all loopholes that criminals take advantage of, perfecting the Penal Code such as: studying and considering re-stipulating the death penalty for the crime of fraud and appropriation of property; supplementing the criminal liability of legal entities; amending and supplementing the provisions on confiscation of property to thoroughly recover assets obtained from crimes; focusing on the work of explaining and applying the law by the prosecution agencies so that the application of these provisions is unified.
