3.4.1.6 How to participate in the auction

- Auction participants can participate in the auction of one or more plots of land in the auction area but only register 01 application and bid the same price for different plots of land in the same area. Submit the auction participation application and must pay a deposit corresponding to the number of plots of land registered for auction.

- Auction participants must pay all the following fees: Auction application fee and deposit as prescribed.

- Currency used in auction: Vietnamese Dong


3.4.4.7 Bidding documents and deposit required to participate in the auction

a. Auction registration fee

Individuals and organizations when registering to participate in the auction must pay the auction application fee: 200,000 VND/01 application.

b. Deposits must be paid when registering to participate in the land use rights auction.

- When submitting an auction application, bidders must pay a deposit to participate in the auction, specifically as follows:

+ Group 01: From land plots with symbols OT05-01 and OT05-18: Deposit amount is 50,000,000 VND/plot

+ Group 02: Land plots with symbols OT05-02 to OT05-17: Deposit amount is 70,000,000 VND/plot

Auction participants pay a deposit to register for the auction by transferring money to the account of the property auction organization.

- The deposit paid by the auction winner shall be converted into a deposit to ensure the performance of the obligation to pay the auction winning amount after being approved by the competent authority. The handling of the deposit shall be carried out in accordance with the provisions of the civil law and other relevant provisions of law.

- Those who do not win the auction and do not violate the regulations in the auction plan will have their deposit refunded no later than 03 working days from the end date of the auction.

3.4.4.8 Starting price, price step, bidding formula

- Starting price

Approved by Decision No. 2889/QD-UBND dated October 27, 2016 of Son La City People's Committee. Starting price for 02 land plots OT05-1 and OT05-18 is 425,000,000 VND/plot (equivalent to 5,902,700 VND/m2 ) ; Starting price


The score for 16 plots of land OT05-2 to OT05-17 is 370,000,000 VND/plot (equivalent to 4,000,000 VND/m2 ) ;

- The jump is regulated as: 5,000,000 VND for 01 card raising (bidding).

- Bidding formula:

Valid bid price = starting price + n * bid step (n is a natural number, n = 0,1,2,3...)

- A valid bid is a bid that is equal to or greater than the starting price and is consistent with the bid step.

- Winning bid price: is the bid price that must be higher than the minimum starting price by one price step, arranged in order from high to low corresponding to the land plot put up for auction.

Through the above table, it can be seen that the land lot with the highest bid price is lot OT05-02 with the winning bid price of 525,000,000 VND because this land lot has a large area and is considered to have the most favorable location. Besides, there are lots with low auction prices compared to other lots in the area such as OT05-01, OT05-12; OT05-13 with the winning bid price ranging from 425,000,000 VND to 440,000,000 VND. The reason for such low prices is because the land lot is small, the land lot is at the corner of the street and the location is less favorable than other lots in the same auction area. The remaining lots have average prices and fluctuate at a difference of 1.28 times.

With the project of auctioning land use rights in the Administrative Planning Area - Buddhism of Son La province, in Sang Village, Chieng Sinh Ward, Son La City with a total area of ​​1624.0m2 corresponding to the auction winning amount of 8,625,000,000 VND. This is the first project of Son La City People's Committee to conduct land use rights auction in 2017.


However, compared to the general level of some similar land areas, there are still many shortcomings such as: Infrastructure is not yet guaranteed, the entire land area is cleared, such as infrastructure work has only been done on gravel roads, electricity and water systems are still sketchy. Therefore, the auction is almost done to sell available land, the value is relatively low.

Thus, choosing the location of the auction land and determining the floor price are two factors that greatly determine the success of the auction project.

3.4.2 Auction results of land use rights in Nam La stream embankment planning area (Me Ban village, Chieng Coi ward, Son La city, Son La province)

3.4.2.1 Introduction to the location of the auctioned land

The land auction for residential land use rights in the Nam La stream embankment planning area (Me Ban village, Chieng Coi ward, Son La city, Son La province) has a total auction land area of ​​1,983.0m2 , including 26 land plots with symbols from OC04-01 to OC04-26, with the following location characteristics:

* Auction form and method

- All 26 plots of land in the land use rights auction area in the Nam La stream embankment planning area (Me Ban village, Chieng Coi ward, Son La city, Son La province) were auctioned once.

Auction by direct secret ballot in 01 round at the auction, open results publicly. Time to write and vote for bids is no more than 10 minutes for 1 plot of land. The auctioneer conducting the auction publicly announces the contents of the auction.

3.4.2.2 Bidding documents and deposit required to participate in the auction

a. Land price participation application fee

- Individuals and organizations when registering to participate in the auction must pay the auction application fee: 200,000 VND/01 application.

b. Deposits to be paid when participating in land use rights auctions

To ensure the smooth organization of the auction, the deposit of customers participating in the auction is applied according to the provisions of Article 39 of the Law on Property Auction and Clause 3, Article 3 of Circular 48/TT-BTC dated May 15, 2017 of the Ministry of Finance, accordingly, when submitting an application to participate in the auction, bidders must pay a deposit to participate in the auction. Specifically:

+ Group 01: Land plots with symbols OC04-01 and OC04-26: Deposit amount is 150,000,000 VND/plot

+ Group 02: Land plots with symbols OC04-02 and OC04-25: Deposit amount is 100,000,000 VND/plot

- Auction participants pay a deposit to register to participate in the auction by transferring money to the account of the property auction organization.

The starting price for 02 land plots OC04-01 and OC04-26 is 1,128,250,000 VND/plot (equivalent to 11,571,800 VND/m2); The starting price for 24 land plots OC04-2 to OC04-25 is 1,050,000,000 VND/plot (equivalent to 14,093,900 VND/m2);

- The price step is set as: 10,000 VND/plot

- Bidding formula:

+ Group 01: Land plots with symbols OC04-01 and OC04-26: Starting price is 1,128,250,000 VND/plot.
